I have e-filed my EAD & AP Renewal last week and trying to send supporting documents and I can't find what needs to be sent for this.....
Questions:
1) Do we need to send any photographs for my AP?
2) Any proof of Identification (passport first page) or Drivers License
3) Any H1 approval notices? (I am still on H1B)
4) Also I filed my AP which is expiring in Dec-08 i.e. 150 days before its expiry and curious to know if anyone�s application got rejected or approved. (I guess 120 days is the limit)
I appreciate your time and response.

My wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

Hi,
I know this has been discussed a lot but I need advise or suggestions..
I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

Hi everyone
started following IV after my friend told me about it. got some useful info and really admire the time members put to answer queries. this is my post and I hope I get some info here. my hubby is looking to relocate to south FL so we both can live and work in same place. he did get couple offers - one from a insurance firm and another from a software company - Citrix. looks like first one will only do EB-3 although the position requires 5+ years exp. does anyone know if Citrix does GC under EB-2 ?

Is NSC processing EB3s regularly?
TSC is not processing EB2s as well ... are they working on EB1s only?
Is it because the Visa #s are exhausted for the period?

If we interpret each and every statement, we will come up with hundreds of comments/opinions. But no conclusion. Right now the processing for AOS is 6 months.
I guess Naturalization means citizenship. Did u apply for citizenship or 485?

The Conrad 30 J1 waiver program has been extended to September 09.
I believe IV core has been actively pursuing the Conrad 30 Improvement act. Can core please update us regarding the chances of this legislation passing in September 09 ?

yes it can happen....
my case: we both filed under premium for our 7th year extension last year and hubby was processed in 5 days, but my H4 took 5 months together with RFE. RFE was stupid enough, they asked to see a copy of already approved H1 7th year.
My advice, wait and see what happens....
Sometimes they pick up H4 a week or so after h1. Good luck.

I think you are required to have passport valid atleast 6months after your interview
"Valid passport. You are recommended to have passport valid for at least six months beyond your interview date."

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

I-130 does play a role, when applying for visitors visa. but that doesnt disquialify anyone from getting visa. you have to show string ties to your country and provide enough evidence that you will come back. there are cases where they hv granted 10yrs multple visas !!
As long as you disclosed your sister's immigration intent in the paper work and sent the right paperwork, it shouldn't be a problem.

i applied to another university and got my sevis transferred to do my MBA there.
i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?
the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
please suggest.

Keep in mind that the validity of a visa refers to the time period the visa holder has to enter the U.S. It has no bearing on the length of stay permitted by U.S. Customs and Border Protection officials at the port of entry. I worked with company A for 6 months and then transferred H1B to new company B with whom I worked for 1.5 years. Meanwhile company A did not cancel my H1B and now when I am thinking of joining company A. Can we use older H1B petition. Is it ok to use older H1B petition or should we cancel older H1B on file and file new H1B transfer?

My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.
My question is:
Will he be able to stay after his visa expiration date?
In other words, when will his I-94 expire?
