hello, i was on H-1B and my employment was terminated yesterday with the company, what are my options of staying in USA. Please advise immediately

My Scenario
-> I entered country on B1 and I applied for H1 through other employer. H1 got approved but change of status is denied as i left the country while petition was with USCIS.
-> I entered country on B1 again with new employer who applied my H1. My I94 validity ended on October 24th and we applied for extension due to some show stopper. Application is still in process.
Here are my questions -
1. Can i apply for change of status now or do i need to go back to India?
2. Now that i applied for extension, if i go for stamping at India immediately, will it be positive? Just because, i stayed for almost around 8 months in US this year. I was just wondering, will they reject it raising doubts on my intent? No one can decide on it, but what are the chances?
3. Staying in Canada on work permit for 6 months and then leaving to India for 3 months and then go for stamping, is this a better option?

It was a mistake by the guy who stamped I-94 (at CBP).
Her H-4 must be expire on your expiration date.
You need to go to nearest CBP office to get it corrected.
She need deferred inspection to get it straight. USCIS will not do it.
OR Do nothing about it and file H-4 extension along with your H1B extension.
If you do not extend her with your petition, even if she have valid I-94, she may end up in trouble later.

My wife is on H4 visa (expiring in 3-20-2013 since she got 5 yr multiple visa). Recently she visited Kuwait and on her re-entry she was given entry (on her I94) up to 3-15-2013 (up to 5 days prior to her visa expiration). Will she also need extension in this case along with my extension or can she stay in US till 2013 with out extension Thanks.

Samething happened to me. On 11/25/2007 i saw a LUD on my approved I-140 (which was approved in Dec, 2006). And then LUD on 12/06/2007 and 12/07/2007 on I-485 for both self and spouse.
Not sure what it could be?? I filed I-485/EAD/AP in late July, 2007. Have received EAD and have done finger printing. Have not received AP yet. Filing Center in Nebraska. My PD is October, 2005, EB3 ROW.

I just received my EAD now. Though I am a 485 july filer, applied for EAD only in January.
My 6 th year H1 will come to end in Oct. Because 180 days since 485 filing is over, I want to use AC21 and change the Employer now, and I am thinking why to go again for H1. I have the EAD, and why not use it, though I will be joining another desi employer.
Does it seem the right thing to do? But everyine else I know changing the employer but again going for H1. Then why at all we have EAD.
I understand that if GC is rejected, and if we are on H1, we don't have to leave. But if GC is rejected, I really don't care. Even if I get the GC, I want to go to Mera Bharath Mahaan.

I can tell you only my plans -- I am planning to visit India for 1 week. My H1-B is valid till 2010 so I will use H1-B visa to renter at Chicago. Also, 1099 or W2, it does not matter. You can take either one.

Hmmm... your attorney needs to spell out exactly what the risk is.
Cross chargeability is a perfectly legal thing to do while applying for your green card. So as long as you have your papers in order, not sure what the problem is.
Ask him for details and maybe you should get a consult with another good attorney who's getting paid by you (not your employer) to make sure you aren't getting ripped off.

I am applying for MBA program in american sentinel university.
I want to know if I am eligible to apply for H1B in master's quota after I graduate from this univ. American sentinel university has Institutional Accreditation by the Distance Education and Training Council (DETC). Please help me in this regards.
Today I called USCIS and they said that they cannot tell anything and only service centers take decision on the case.

On page 7 of the Instructions for Form I765, under RENEWAL EAD, it is mentioned that no filing fee is required if we are applying under the category (c)(9) or (c)(16) Adjustment applicant who applied after July 30, 2007.
I applied in the 2nd week of August 2007 (but it was still in the July 2007 fiasco). So do I need to send application fee when I send my I765 application for renewal??

Just carrying a copy of the receipt is sufficient. Normally the officer will only be interested in the passport and original AP document - that was my experience recently coming into the country.

I don't think core is going to spill it's strategy on the forum for world to see. I would suggest you to join local chapter to know how things will be performed. :)

I obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.
My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?
