One of my co-worker was in same boat. His desi employer revoked his I-140 when he took fulltime employement in 2005. He got his GC finally.
I am in same situation. As of yesterday, my previous employer would have revoked my 140.
I already sent the AC21 letter, there are no LUDs. My attorney says, chances that the letter may not go into the file are high and the reason we send AC21 paperwork is to keep a record that we sent. I took a screen shot of the DHL tracking info too.
Any ideas how to ensure that AC21 paperwork is getting into your file.
The answers I see on this forum is
(1) USCIS is overwhelmed with documents so mail can be trashed
(2) USCIS clerk does not know how to handle the paperwork
(3) USCIS certifying officer is not well educated about AC21

I just wanted update this thread with my experience. Could be helpful to people like me who searched many forums frantically. I have 10th year h1b extension valid upto 2010. Instead of going for stamping at US consulate in India, I decided to use advance parole. Most troubling thing about my history was that I had one dwi (Driving While Intoxicated with Alcohol) offense. It is not a deportable offense. However, I was concerned that it would show up at port of entry and they could ask me to go back for consulate processing. I kept all my case related court documents handy. This is very important for anyone travelling with dwi or other serious charges against them.
Officer directed me to the secondary inspection. Another officer there entered my information into the computer and after making gazillion keystrokes, he stamped my advance parole document/I-94 with 1 year validity. I got up from the chair when he called my name, walked upto his counter and took my documents from him. NO QUESTIONS ASKED. NO BIOMETRICS.
Hope this helps others.

This is called waste of brain power ... cramming as much as you can from the dictionary and god knows what. It would have been much better if a child learns some skill or diverts the mind towards exploring a problem or invention . And always send via USPS express mail. (1 day costed me $18) but I came to know instantly the next day that they received it.
You could also use some cheaper USPS option. as long as it has some delivery confirmation.
The reason I like express mail one day, is because u can request a copy of the receiver's signature via email (comes in a PDF). This is proof that USCIS really got it and u can then sleep nicely for the next 3 months.

can you hold these meetings on saturdays? weekdays are impossible for me with a 1.5 hr commute (common with most tri-state folks).
informal get togethers can be held at the flushing hindu center on sunday evening, at least for those who are hindus living in queens. (the majority here, i guess)
The idea was to make it easy for majority folks who work in Manhattan and surrounding areas. We were also concerned that the tri state folks travel long distances and work long hours during weekdays will need the weekends for themselves and a Friday night after work must be the best time.
But, yes, based on majority of the folks's response, we plan to do one more on a Saturday, but not in Flushing, location will be decided soon.

Sorry!If it was rude!!No offence meant...Me thinks it is more of a pain than gain!!Like what if your 485 gets approved b4 u file for your spouse's...There are still solutions as much as problems!!It would only benefit guys who are desperate for EAD but then again if you have your I-140 cleard and with serious retrogressions expected you could still get 3 year H1B extensions!!!

Definitely not at the place where I am working.
The place where I work, people eat burgers in the meetings and we have a very small kitchen in our floor and there is no Cafetaria as such. If I had to put up with the burger smell, I expect my co-worker to put up with my Indian food smell too...

What will the numbers reveal? I had been a regular blogger at IV, but I stopped coming up here because.
1. All talk and no Walk
2. New members come aboard, are rude and offer no pragmatic approach.
3. All these bloggers give ideas and critique each other.
4. What happened to the March1 09st rally in DC?
Why has IV not taken a pragmatic approach, don't take me wrong I respect what you have done and other approaches in the past. But IV is using same approach for a new problem, the end result-----Failure
I joined this community after july fiasco, and have kept close watch on dates, everyday members keep suggesting something or the other. I don't mind being a donor to IV or contributing little what I have, But I need to see some big movement and results.
I did all the stupid calling to congress senators
Did sending of letters to the White house
what was the result? If IV wants core members and new members to donate and be a part of something bigger than a website, then please initiate something big like a rally.
Just because their are less members to join, does not excuse a true purpose of a rally.

Please prove me wrong and IV to be something more than a website, please initiate something big and real, and not just comments. I an aware of the achievements in the past, but it was past 3 years ago. For last three years immigrant's feelings have been played around too many times. Same old talks will not bring upon a change, SOMETHING BIG NEEDS TO BE DONE NOW BEFORE THE CIR BILL takes place. So people are more aware.
Show us IV core is more than words! Conduct something bigger that will attract new members and donors to this organization.
I as a professional can tell you all now--- passive movement, sending letters, long term planning with no actions will not help
People have left IV, who are so disheartened and believe this organization has lost its eedge and is all talk and no walk above all a money scam.
Prove them wrong and do something big, above all Practical

Instead of listening to us and contacting us with disagreements he chose to take a path of confrontation and damage IV’s reputation. Such members have the courage to speak against IV but will not dare speak against websites that are working overtime to throw this community out of this country. We will not tolerate such folks as an organization that is genuinely and honestly working hard to help its community. The website he chose to post against us does not delete posts against us as it sees us as a threat to its business interests. I hope our members see the difference. We have already given you a call on the number in your profile to clear any questions you may have, hear your ideas and have you work with us to fix the immigration problem.
Please also do not forget that past successes of IV like July bulletin and 2 year EAD was because of the hard work of our members. We need to give ourselves due credit for it. You are correct that there is talk and talk and no work. We get calls from reporters and post requirements on IV site but due to lack of response, we have to pass it. We have requests from editors asking for op-eds. Some of our members see hope in the current bills and when we told them the reality and the probability of those bills at this point of time, they get disappointed. We can also start multiple action items to vote on sites or send junk emails, but it will not do anything to help us and this is not want we want to keep doing. Each members time and effort is important and used where it will matter the most.
What really will help us is grassroots advocacy effort at this time and this is a long process. We have been doing it well over the past few years and learnt a lot from experience and mistakes. In the recent time, we did ask people to poll on the thread if they can come for a DC rally in March09. The participation was within a couple hundred I guess. We seriously want to do a big event this year in Sept Timeframe when we expect some movement of our bill. But one cannot just do at the last minute. Planning needs to happen much before the event. One or two or even 10 people cannot plan such a big event. We will need many hands. We telephoned each state chapter leader individually to talk about it. We posted their action item items and emailed them a few times. If you are not hearing from them, you may want to call them up. If they are not active, you can also take that role . We really need teams of members from each chapter ready before Sept. If a chapter wants to do a local event before that they can do it and we will support it.
Now coming to your question about core team. Core team is nothing but people like you. People have high and low times of availability like everyone else. In this bad economy there is work pressure too and everyone tries to squeeze time whenever they get. No forum postings does not mean some of them are not working. There is division of roles and having everyone come to forum and post is a waste and duplication of effort. Not everyone can have patience and availability at all times and some choose to stay away for a while or are burnt out after a long and thankless hardwork. There is no closed door. If you want to lead and be a core member to lead from the front or leader for a specific agenda, you are welcome. This is how IV can be run and managed on a long term basis even after you and I have greencards. If anyone wishes to volunteer or talk to us, let us know. IV phone and email is listed on the website and we will talk to anyone with concerns or questions. AND ONE MORE THING. THESE PROCESSING DATES ARE FOR RENEWAL APPLICATIONS. NOT FOR NEW APPLICATIONS. FROM MY EXPERIENCE I SAW FIRST TIME FILERS ARE GETTING THEM IMMEDIATELY THAN RENEWALS WHICH WERE TAKING 2-3 MONTHS.
It does not anywhere say that this timings are for renewal. I have my 3rd EAD now. Everytime, I got my EAD approved based on processing times given in the web site. I found one difference, when I filed my 1st and 2nd EADs at California, I got them in 1 month(but again based on processing times). Now the 3rd one, I got in 3 months(again based on processing times)

create a yahoo group or blog..and have ppl publish the name anonymously of the desi bloodsuckers...some kind of activism is required..instead of coming on this board like some ballless buggers and crying like babies...grow up and take back ur life...bytch..;-)

Remember in life you have to have an attitude of respecting others, if u think you need to be treated specially cause you have lived in America 10yrs then u would be definitely disappointed. A lot of my friends have relocated to India and I am too early next year. The only answer is attitude.
But there are cases where you expect to be treated like a human , and you are not. That is the most difficult thing for some who returned and regret doing so.
And it is a bigger dream (than dream about getting GC) to expect people to leave en masse .

All arguments are very sensible. No doubt about it. am working on an EAD and they did not incur any legal cost. However, I get frustrated thinking why they charge $180 per hour to the client.... even when the cost to company for me is about $110K per annum or around $60 per hour. I do not know whether I am worth $180 per hour or not....but probably more than $60/hr since they can charge $180 / hr
We really need to analyze this deeply if we want to come up with a strategy....

It is simple economics. Demand and supply.
If you quit they will find zillions of people of same qualification waiting to take the same for $60
Ideally , if you want to find out how much you should get/worth , put yourself in the market and do interview and try to negotiate and see what the range you are being offered . You may not take the offer but at least you will know where you stand.
Be aware full time ( with all benefits) and W2 / C2C/ consulting rate are very diffrerent and another dimension is region for different rate.

Dear friend
It looks like you can show some light on my stuggle with ICICI bank to deposit money in My ICICI NRE account.
Story is like this, I went to India this summer deposited money to several mutual funds from my ICICI NRe account. One of the investment (in franklin ) was wrong by the mistake of my agent ( because US person can not invest in some of the US based mututal funds and frankln is US based fund) So I had to struggle to get money back from Franklin, as it was not proper investment ( wer mentioned NRE US based in forms, so they should have out right rejected investment, but they alloted it and then I have to fght back to get it returned)
Luckly due to my correct application I was able to get money back from franklin. they issued RS check, which I tried to deposit to my NRE account at ICICI bank. ICICI rejected check saying it is in RS. I tried to persue them it is REFUND FROM MUTUAL FUND (NRE INVESTMENT) from the same ICICI account but they still wants the proof that it NRE money. I have still this check bouncing back between me and ICCI bank. I also approached franklin to get letter. This time they have qouted some earlier RBI rule ( I have not read letter) and I am trying to redeposit that with check again.
Here in this My bigger question is we all are investing lot of Money from NRE account in Mutual funds and other investment options available to US in India as NRI. but when it comes to getting money back in our NRE account ( naturally all returns/refunds from India investment will be in RUPEES CHECKS ONLY) then we have big trouble like One I am facing right now.
SO DOES OUR INVESTMENT IS TRUELY REPRETRIABLE.
WE CAN GET OUR ORIGINAL INVESTMENT AS WELL AS GAINS ON THAT BACK TO NRE ACCOUNT OR NOT
IS IT THE ICICI BANK ONLY or ALL OTHER BANKS ARE GIVING TROUBLE wHEN WE TRY TO REDEPOSIT OUR MONEY ( in rupees) back to our NRE account.
Please explain your experiences in this regard.
If possible also provide links that talk in more details about REPRETRIABILITY OF NRE INVESTMENT
Also let me know which is best NRE bank to work with without any such hassles in India?
It looks like you can show some light on my stuggle with ICICI bank to deposit money in My ICICI NRE account.
Story is like this, I went to India this summer deposited money to several mutual funds from my ICICI NRe account. One of the investment (in franklin ) was wrong by the mistake of my agent ( because US person can not invest in some of the US based mututal funds and frankln is US based fund) So I had to struggle to get money back from Franklin, as it was not proper investment ( wer mentioned NRE US based in forms, so they should have out right rejected investment, but they alloted it and then I have to fght back to get it returned)
Luckly due to my correct application I was able to get money back from franklin. they issued RS check, which I tried to deposit to my NRE account at ICICI bank. ICICI rejected check saying it is in RS. I tried to persue them it is REFUND FROM MUTUAL FUND (NRE INVESTMENT) from the same ICICI account but they still wants the proof that it NRE money. I have still this check bouncing back between me and ICCI bank. I also approached franklin to get letter. This time they have qouted some earlier RBI rule ( I have not read letter) and I am trying to redeposit that with check again.

Everyone knows that King will keep adding ammendments, the only way this bill can pass todays hurdle is if they have some kind of a back room deal where King gets to show he is against the bill but allows a vote towards the end. The fact that he was able to bring up so many ammendments shows that the prior negotiations failed or did not occur. Most of the grunt/real work (deal making) is off the camera, on camera they just pander to their crowds.
King will, as usual, will come up with alot of amendments again. By the way, they have to finish with the horse bill and then they will come to our bill and then they have to finish the nurse bill. All the bills along with the Mr.Kings amendements have to be done in 2hrs because it starts at 3PM and ends at 5PM.

I felt there were too many fields to fill in. It might help if we can take out some fields. Like RFE etc.
in the current system it is not mandatory to fill out all the fields. if you want to leave out RFE, you can do so.
We felt that some people want to track RFEs and see how it affects the overall progress of the case. Even though we do not have such calculation, I think it would be worthwhile to have an analysis done on that. It would help people know when an RFE is generated how far their case is pushed back. RFE information will also help people in the same boat and they can make such people as buddies and monitor each others cases and contact each other to figure out what is going on or how the RFE was replied.
