A quick analysis of election results and its relevance to us:
As of 11:45 PM PST, House has gone to Democrats in a landslide; the Senate is on its way depending on outcome in Montana and Virginia. If Democrats win MT and VA (Jon Tester in MT, Jim Webb in VA), the Democrats would control the Senate too.
What it means for us:
Change of control in the House:
This is of biggest consequence. Since Democrats won the House, every chairman of every committee in the house will be a Democrat. They will decide what goes into each committee, what comes out of the committee, what gets floored on the house floor and when. They set the agenda, they set the timetable. They run everything...including what gets served in the House Cafeteria and who occupies which office and who gets how much budget to run their offices. Republicans in the last few years have followed the mantra of “Majority of the majority” when it came to setting the agenda and timetable of house floor votes. What this did was, bills that would win the majority of 435 votes by combining Democrats plus moderate Republicans never got floored onto the house, since the majority of majority (conservative republicans) were against such CIR and by that token non-receptive to the legal variety of immigration.
To get an idea of the minority in the house read this quote from more than a 100 years ago:
”The job of the minority is to make a quorum and to draw its pay.”

I feel sorry for the people who live in slums of dharavi but not for people who should not have been in the US in the first place (based on their education) and are now finding ways to get ahead of the legit EB2 candidates by buying masters degrees.
They are NOT buying MS, they are inquiring where the fees are cheaper. If this is buying MS, even you *bought* your Masters (and every other degree) unless you are from the 1% who get full scholarship (you would definitely have been in EB1 had you been in that layer).

Not able to work does not directly cause loss of self esteem. Sorry to say this but this is the bitter truth. if you or your spouse's self esteem is so hurt because of the inability to work, fight for it and get H-4's the ability to work. May be this is not a prediction thread. But the OP and some others are all about VB in another thread or two. While I personally dont have any issue with it, it just frustates me that people dont understand that VB is not going to do any magic for PD's in 2003 or later. C mon Lets be realistic. After doing all the math in so many threads, Does any one expect that the PD will be some where in the ending of 2003. Hell no. Then why is that we have a Dec Bulletin thread way back? Now some one is gonna come start a Jan prediction thread. Useless. I hate to comment on this but I hope people understand the difference between discussion as you said(which I personally agree) and useless predictions when they can make educated guess and do something else.

I am very thrilled at the news that our President has own the highest honor of this world.

I and my family feel immensely proud that we are able to live in this country of freedom governed by a great leader like you.
Mr President you are the symbol of hope not only for the citizens of USA but also for all of the immigrant community. You have raised our hopes that we will also be able to become a citizen of this great country soon. Your selection as the Nobel Peace Prize winner has strengthen this hope further. Sir, Please do not belie our hopes.
Please revamp the current immigration rules and provide immidiate attention to the immigration reform. Sir, we all are looking up to you.

This is simply putting cart in front of horse ... he hasn't been president for more than 9 months and hasn't solved a single economic problem our country is facing.
And if being simply president was creterion than our ex-presidente (Mr Cheney ... oops Mr. Bush ;)) would had got 8 noble prizes + 4 from Papa. It re-inforces my opinion that europeans are ... simply out of touch w/ reality. Look america has already showed world, it can elect a black as a president from country of pre-dominatly white ( still white, check census). And what have these european self-labeled-elites done comparably?
If you think this person has vision and can solve worlds problems than do as he asks. Join us in fighting global terror, economic troubles and uplifting democarcy in middle-east.

Hi,
I have a question about leave of absense. Does it mean that you are still employed with them if you apply for LOA? If yes then you cannot work for another employer at the same time, not on H1B atleast.
I would like the gurus to share their opinion of the following option:
Join the new job and start working there. If there is an RFE in future then you can go to your old employer and ask for a offer letter (with the promise that you may or may not joined them) and also one from your current (old) employer. If the adjucating officer says that the letter from the current employer does not qualify under the same/similar category then you can show him the letter from the old employer offering you a job. This will satisfy the requirements of having a job offer at the time of adjudication. Though in this case you will have to join your old employer.
Gurus: Is this possible? Or are there kinks in this theory?

Actually very true. I for one have held off on buying a gun (though my wife highly disapproves of guns) simply because I dont have a GC and dont want any hassles. Besides I live in Chicago which has a ban on guns. Ironic that the maximum killings and drive by shootings happen maybe 30-40 blocks from where I live but the city doesnt allow legal law-abiding residents to own guns.
Maybe we should tell NRA that lot of skilled immigrants will buy guns once they have GCs. That could be the fastest way for us to get some lobbying money. It could work faster then the message on "buying houses".

Just because one can apply for PR with Canada and Australia easily, it cannot be assumed that the process would be similar for US. I do not know about Australia, but comparted to Canada, I am pretty sure there would be more people wanting to come to US and the restrictions are going to be more. Three things are inescapable here for anything to do with the feds: tax, lawyers and lawyers. Any immigration reform in which the lion's share does not go to the lawyers will not reach even the banks of Potomac.

I think we should call and tell them that highly skilled legal immigrants are working for long time and the jobs are granted because there is a shortage of highly skilled immigrants in US. We are waiting just because of the inefficiency of USCIS.

That means that there are no �unused� visas from past years to �recapture.�
Moreover, these extra green cards would be for foreign workers to take engineering jobs, health care jobs, construction jobs, manufacturing jobs and just about every other job that Americans have been losing in this economy. In order to qualify, a foreign worker doesn't need more than 2 years of on-the-job training � and they aren't even required to have a high school diploma. Our country doesn't need these workers - our workers need these jobs!

* No. 1: Go around Sen.Menendez who has a "hold" on H.R. 6633, the "clean" E-Verify re-authorization bill passed by the House. Sen. Reid can bring this back-room filibuster to the Senate floor for a vote. If he does this, there easily will be the 60 votes necessary to stop Menendez and allow an overwhelming majority vote to pass H.R. 6633. (Reid reportedly doesn't want to do this because he doesn't want to force some of his Democrats to have to go on record just before the election.)
* No. 2: Avoid a vote altogether by talking to Menendez privately, persuading him that what he is doing is threatening the reputation of the Democratic Party just before elections and get him to withdraw his "hold" on H.R. 6633. (This way, Reid could then bring H.R. 6633 to the floor in the "hot-wire" fashion which will pass by voice vote.)
Either way, the American worker and public wins. It is all about Reid doing one of those two things.
This is why we want you to put particular pressure on Democratic Senators to put an end to Menendez' shameful grandstanding. Fortunately, Senate Republicans are standing firm against Menendez.

After we told you that some Republican Senate staffers were working with Sen. Menendez (D-N.J.) for massive increases in foreign workers, you hammered Republican offices for not holding the line for a "clean" E-Verify bill.
Your efforts really worked. By the end of this last week, Republican Senate staffs were going into negotiations with Democrats and making it clear they were united in oppositiion to a foreign-worker surge at this time of 5-year-high unemployment and financial industry collapse.
Sen. Menendez apparently is not bothered by the 5-year-high official unemployment rate -- or even by the 292,000 additional American workers who went on unemployment in August alone. He is insisting that if we keep E-Verify, then we have to add another 550,000 foreign workers next year to the 1.1 million immigrants already scheduled to come.
(AS A REMINDER: E-Verify is the central tool for taking away the job magnet from illegal immigration. The U.S. Chamber of Commerce wants to kill it so outlaw businesses will have more freedom to hire illegal workers. E-Verify is the on-line system that businesses can type into for each new hire and find out if they are an illegal alien.
(If you live in Arizona, Oklahoma, Georgia -- or any other of the places that have started mandating that businesses use E-Verify -- your efforts to combat illegal immigration will be halted. )

Eb2 have never moved beyond may 2004.. so until it goes past that.. these movements are not really worth anything.. it has to overcome that resistance.. then maybe 2005 will be a reality

Lets not hope for results just act. If Gandhi could drive Britishers out of India using this approach, USCIS is also made of human people and sure they will do something to lessen our pains.

EB3-India cannot be discriminated.
Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.
And exactly how is India being discriminated? Do you have proof that they are giving India less visas than the per country limit?

We could not even pool $10K for FOIA. For lobbying, one needs lots and lots of money in the range of 100K -200K. What can IV do? Can you explain what you mean by "something'? if all of us EB3's can pool 100K, then we can request IV to do "SOMETHING". Hope every one understands this.
How is anybody sure that by spending 5K or 10K, you will get what you are looking for? Just because somebody quoted 5K fee for such an information (which may be their standard response to such custom information extraction requests), it does not mean it can be readily found. If it were that easy, USCIS/DOS would be using it. The fact remains that PD related information does not exist other than in physical paper applications/files related with LC, I-140 and I-485. There is nothing on the system based on PD's. Don't we see it in guesswork used for advancing and retrogressing PD's. Note that for most immigration applcations PD's do not play any role. Only when at adjudication time, birth country is noted to be India/China, the officer has to check PD with respect to current cutoff dates. Systems are not designed for handling any processings based on PD's, so quick access to such information is not available - with a fee or without a fee
