Did AILA actually file a lawsuit?

It was lawsuit filed by AILA, efforts by IV and other groups that reversed the decision. Gandhigiri in this country has very little value. This country works on laws/court system. We need to get laws to help us and we need support groups like IV to make that happen. Or else we can pray to God to shower some green.

This can create fights amoung us. This is like divide and rule.. It did work in the past,. so we must make these guys do EB2 and EB3.
BUT they bring some very good points.
EB3 will go nowhere unless we act. Very Correct.
They want to do something and looks like decided with a plan.
There is a chance many EB3 Indians getting influenced as they too dont see any hope and there is nothing happening from IV in last 1 year except one or two in last 1 week.
Writing to service centers is a new idea even I didnt get so far.
So are we seeing these guys very soon in white.,. lets see.

It appears that you are cracking a joke, but I cannot stop from replying to your post. Why are you asking God to save IV? For the things we cannot do or for the things we dcon't understand, why do we always have to bring in 'God' in the picture? Can't we even crack a joke without brining in God?

One does NOT need EAD to use AC21. I don't understand the panic.
In fact, one can be working at Employer B and can claim AC-21 for Employer C as a future job.

I was not planning to change company and just filed my 485 without EAD last week. But now situation has changed and the lawyer said i need EAD if i want to use AC21 after 6 months. I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

not personal, addressing many issues.
1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.
2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.
3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.
4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.

Hope you all are doing well.
I will join you folks. I was there at San Jose rally, DC rally and advocacy event, will be there this year. Good to see some of the returning folks. Last time California had more than forty members at the DC rally, probably the reflection of the state of economy and urgent need for immigration reform at that time. Time have changed and many people's circumstances have changed but our resolve is unchanged. Last time our advocacy effort impacted the lives of hundred of thousands of people who were able to apply for their EAD. Sweet victory for IV members and hats off to their leadership in this area.
Now, we work to help gather support for a CIR bill. I am excited about this. Lets do this.

My advice to most people who do not perfectly fit into eb2 is to do the eb3 petition first (which is guaranteed to be approved). Get your place in line for the greencard.
Good suggestion.
If it is taking too long then you can try an eb2 later; if it gets approved then you will get the old priority date. If it doesn't; well you can say you tried but you didn't lost your place in line for the greencard because you still have the old eb3 in place.
As if the porting rules are going to stay the same. There are many things legit eb2 people are doing that will make this bogus porting impossible.
However, if your cases is not clear for eb2 and you try this first and it gets denied then you will lose valuable time in line for the greencard because you have to start from the beginning.
Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.
However, this isn't the same criteria DOL uses. They will state that if a person doesn't have a degree then you are willing to accept 12 years of experience which is excessive and they deny the labor (before they were giving hard time to eb2 but not it is eb3 that they are after). So now we have an issue that DOL criteria is different then uscis critera. You use dol criteria, labor gets approved but 140 gets denied. Use uscis criteria and labor gets denied.
Now, everyone has to adjust and file eb3 labors as skilled workers and only require two years of experience (it's getting more and more messy)

Actually, contrary to your understanding, I think the officers denying the DL application understands immigration law. Submitting an extension application absolutely does not mean you have had the extension, since it might be well rejected. Issuing the DL can only be based on approved documents.
Your luck actually lies on meeting some officer who does not understand immigration law, or any law, thus give you a chance to slip through.
This is a problem because the DL people do not understand the immigration law. I was in a similar situation 2 years ago in Iowa. Tried to explain to the manager of the office, but got a lecture on how good their public transport system is. Then I went to another DL office in a rural county. The counter clerk refused, asked to see the supervisor who agreed to extend for 6 months by which time my extension came through.

Yes, you have to indicate. If you don't and they findout it would constitute perjury leading to revocation and possibly complicate your life further.
I-94 form does not have any such thing.. But DS-156 and 157 might have.. so if the guy goes and does not apply for a visa he shud be fine i think...

Even if every member of IV is given a green card this afternoon, none would be able to vote in 5 years, unless you are in the military. We have less connection to the citizens in the United States than the undocumented workers. Latino citizens vote for more Latinos, but some Chinese citizens may think there are too many Chinese in the United States already!
In one word, none of us can vote in 5 years. Neither can we persuade the citizens we know.

The point is that me and my company and you and your organisation have paid a service fee with a reasonable expectation of service. reasonable expectation of service is subject to interpretetion based on common sense and no f**king common sense says that waiting 10 years for GC is reasonable .. unless your common sense has been replaced by self disrepecting logic ....
i am not a lawyer but i think that when you pay a processing fees to apply for a privilege (drivers license, business permit, visa, green card etc) from the appropriate statutory authority (DMV, USCIS, Dept of Commerce etc) - the payment of fees does not make you the customer of the statutory authority - so to the extent that USCIS has not broken a law to discriminate against a particular set of applicants (class) - a class action may indeed have no merit.
However, if it can be proved that there has indeed been gross negligence or that USCIS has not followed its own established procedures, made commitments but not honored those, lied or broken the law of the land - then there may be a case.......
another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

I respect all the holidays and I would like to celebrate with you guys, but what is the meaning of Diwali?
Diwali (or Deepawali) literally means the festival of lights. Traditionally it has symbolized the arrival of Ram (a Hindu mythological figure often perceived as God) back to his kingdom after completing a 14 yr exile.
However other religions in India (notably Jainism and Sikhism) have different reasons for celebrating the same day.
Notwithstanding the different reasons it is commonly perceived as a festival of lights and of the victory of good over evil.

Any one has info on working and living in Australia.
I see in 12 months i can get Immigrant Visa... Cost is $1960 ..
Canada may be cold ..Australia has beautiful weather ..
But the cost to buy Australia would be slightly more expensive than for a small out of the way nation in Africa. (Anyway I am ROW from somewhere in Africa so it would be better to just go home)
