Folks,
Per lawmaker we recently met(WA state), it is imperative that we also get our message across to lawmakers in the midwest and south.
Due to resident strength and businesses employing H1B people(who end up getting stuck in retrogression) in the west and east coasts and large metropolitan cities, the lawmakers in these areas are slightly more aware of our issues. They also get funding from local companies that employ people stuck in retrogression.
However, representatives in the MIdwest and South do not get a lot of funding from local businesses that employ H1Bs and have other local issue that they would rather pursue(agriculture, etc.).
It is imperative that awareness is spread in the midwest and south !!

The first thing to do in call your attorney and ask him to be with you when any uscis or ice guy shows up. Right to an attorney is a basic right. Do not think that u will offend ice officer if u have u'r attorney present. Do not think that u'r charming personality will put u in the good books of ice. If I were u, I would not do anything, without consulting my attorney in such a matter.
Also, keep bank stmts and all recent paystubs handy, along with past exp. Letters and degree/certificates. Copiew of h1 + gc petition/approval would be good to have.

I have one week from now for his visit. He gave me his desk number too. So I guess he is still an ICE employee. I did not call him at that number though.

6 years for everyone? is everyone's PD 2007? Are they going to issue GC only after 6 years? use a little common sense and you will find that GCs are given based on PD, Older the PD sooner you will get GC. for example a person with PD 2003 will get GC within 6 months.
I am not sure of this but from studying data, I get the impression that the GC are given out on a FIFO system based on when USCIS receives your I-485 (assuming it clears NC) and NOT PD date

friends ..are we giving up before even trying ??? this is the least that we can do ..just write that you are a skilled legal immigrant with american kids. you have followed all the rules for 6-8 years ..waiting for a GC so that you can buy a house (or if you have a house then there is a danger that it will go in foreclosure because of GC delays) ..few minutes is all that is needed

My I-140 approved from TSC and I-485 submitted to NSC on July 2nd 7:55am. I talked to 2 immigration officer today morning. They informed me my case would be transfered to TSC. I dont know if NSC would receipt my application:confused:

Its not all about being Wise. I was stuck in a BEC for some time, but my company refused to refile under PERM for me.
Folks who missed the window - believe me, despite some insensitive remarks now, and in the past, IV is here for you and is working on your unfortunate predicament.
My best advice to those affected by the continuing BEC mire is to join your state chapter, make sure your voice is heard on a local, grassroots level.

I guess MOST of the people are concerned about the quality of photos than $ spent. My friend had RFE because the photos he got from CVS were not upto USCIS specifications. So any + experience is valuable to the forum.

Let us focus on the rally and recapture of visa numbers. This more important to all than fighting out the LS issues and finding fault it is not our issue. If the LS guys gets rejects, they deserve it for not using their own Labor, and they a price for the same. Let us not beat them with a stick and focus on what can be done now.
Let us not build hatred against anyone, this can only undermine our efforts. You never know, heard FBI Checks are strict on LS folks, hope that is true, atleast genuine filers get it based on their PD, so be 2001 or 2002 as long as they are the original beneficiary.
Where is it mentioned that LC sub has been rejected ? I looked at the link and
I couldnt find any thing.

We had the appt wt infopass the other day.I guess it was just like others,some kinda error and that happened opening the SR wt TSC.They said our case is preadjudicated.and said we may want to check on the case by making an appt wt the center but maybe NOT calling and opening a service request.What a waste of time n energy, all the agony we had to go through!!
NOW guys i have some other issue/question to ask u all.
After the EAD is approved do u necessarily have to be working for the same employer who sponsored for you? Ours is like future appointment.The USCIS wanted some docs from us this June re the appontment/work related.And yesterday when we asked that officer she said our case is preadjuticated as of Oct 2009.So far we have taken couple of paychecks frm the sponsoring company.But then we have our own small business also that has kept us going.And we were thinking of taking more paychecks after the GC is approved.Does that make sense to you guys? or are we at fault?

Desi consultants should be heavily fined or shut down if they get caught in filing multiple petitions. Why doesn't USCIS take reasonable steps to avoid these kinds of fraud. i hate it when desi consultants hire people from business background and file a H1B for them as a DBA's or programmer analysts or QA's....!!!

I will be sending the following note to my senator and have already posted it to WhiteHouse.gov. I urge all those screwed by the ongoing retrogression to do the same.
"I am writing to inform you of how the country based quotas imposed on Employment Based green cards are unfair and totally illogical. When I immigrated to the US, I believed that this country was a meritocracy where you were judged based on your abilities and qualities. These country based quotas reward people depending on where they or their ancestors were born. This causes people from India and China to wait over a decade to get a green card whereas someone from another country with similar or lesser abilities can obtain permanent residence in half that time.
Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this discriminatory policy and reinforce that America is truly a society that celebrates meritocracy."

I think we need an IV movement to fix the Indian Consulates - They are absolutely pathetic - Lets get our house in order before we try to fix the USCIS !!! Does anybody know what is the email address for Meera Shankar - Indian Ambassador to US. We need to bombard her with emails about how badly the Indian consulates in the US are run.

If the hosung markets turned down like the NASDAQ 5 yrs ago, and brought down the whole economy with it, then as a result of the ensuing economic recession you lost one, two or all 3 of your jobs and ended up in negative equity, could not find a new job sponsoring H1b due to the deep recession and your greencard is nowhere in the near future. Would you still feel as secure and happy? I am not sure what country you are from, but would you make a salary close to what you are making here?
Security my friend, thats what a green card brings. I applaud you on your courage and bravery in just taking a chance and doing all these things, you will likely be fine and get your green card eventually but taking risks can bring consequences as well. Many people are more risk averse than you.
A GC is going to make finding a job a lot easier & is going to make you feel much more secure than a H1 is a fallacy in my opinion. I think, if you currently have a H1 job, you have proved your worthiness in the job market. In fact, you are probably better off than a GC holder, since you are forced to be on your toes to maintain and update your skill set for fear of the difficulty in finding another H1 job.
I have plenty of (EB) GC friends around me who got their GCs through their job through the 1996-2000 .com boom, but now have trouble finding their 1st right job, post the GC. They missed out on the 2002-2005 housing boom, all the time while I, on a H1 was reaping the fruits of taking the risk and getting in while still waiting out on my GC.
Besides, in a global economy US jobs themselves are far less secure than during any other times in modern day history, so even a US citizenship is not going to make one feel secure with regards to employment.
What is going to make you feel secure ultimately is being well qualified & well skilled. For people with the right qualifications and skills there will always be a H1 job (or for that matter a well paid job no matter what the geography) out there. In my opinion, having the right skills and qualifications is one's security, and that�s what I have always banked on while moving so forward on a H1.

WOW --Right from relationship between coutries tot he pros and cons of war planes we are discussing here.We have people with nice political knowledge per se Ministers and Kings who can analyze how just 11 billion (bully)dollar deal can affect the Green card processing and we have Generals and colonels who knows which fghter plane is good for which country.
But still we are able to manage only around 200 for the advocasy event and large amount of donataions which barely met the expenses. what a pity ;)
