Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.
Finally they dont reject application nor they will accept it...
Guys send flowers with all your comments on JULY 10TH...we may get media and political atten...
this is just my 2 cents.
Thanks,
Chandra.

Actually very true. I for one have held off on buying a gun (though my wife highly disapproves of guns) simply because I dont have a GC and dont want any hassles. Besides I live in Chicago which has a ban on guns. Ironic that the maximum killings and drive by shootings happen maybe 30-40 blocks from where I live but the city doesnt allow legal law-abiding residents to own guns.
It isn't an outright ban. Chicago doesn't allow concealed carry, and requires guns to be registered, but you can own guns. Yes, the process for legally owning a gun in Chicago I understand is very tedious (sad, I know), but not impossible. Much like NYC.

I got 2nd FP notice (first one was done in Aug 2007). I was not expecting this as my PD is oct 15 2001, EB3, Mera Bharat Mahan(India), off by 3 days with the current and next bulletin.
Its code 1, so only finger prints.
What is the logic behind FP for every 15 months??

So looks like only the renewal will have a delay. First-timers won't face much difficulties.
It might be a problem for those people working on EAD and waiting for renewal since they can't work if the renewal does not come in time. Why does USCIS not allow grace period for people to work based on receipt , the same way it does for H1b??

Mindblowing. Do people really believe the Oct 2007 deadline? Haven't we seen many deadlines come and go? This is extrememly unfair to those stuck at BEC; don't go around spreading this impression that the BEC issue has been resolved.
If indeed the majority at IV believe that BEC is not a problem, then it would not be a stated goal of IV. Let me repeat, so long as it is listed as a goal, it is the moral responsibility of all of to support and work towards resolving the issue.
This is important. Don't just pretend to support IV and play down what matters to others. Your must support all the goals we have at IV and not pick and choose what you like.
Also please don't repeat the false logic of "labor certs will be taken care of by PERM." If that is the case why would we at IV have BEC resolution as a goal? The least you can do it not try to dilute the seriousness of the BEC issue, even if you don't care much about the problem.
anai,
Resolving the BEC problem is definitely one of IV's main goals. There is no way I will believe in DOL's claim of clearing all the back logs by Oct 2007.
IV has had a number of discussions with lawmakers and administrative officials, first to understand the issue and next to solve it. From our discussions, it has become clear that the lawmakers still view this as a temporary problem and are not willing to legislate for getting any more into this. Never the less all of them did agree that the efficiency of the BECs left a lot to be desired. So we were working a bi-partisan coalition of lawmakers who were willing to put pressure on DOL and USCIS on the need for efficiency and transparency.
All of this was before the crazy pace with which the Comprehensive Immigration Bill began to move. We do have to realize that this bill is a golden chance to have our provisions in place and we have less than 2 weeks to works on it. Frist wants either of the Immigration Bills to be passed before Apr 7th. If we do miss out on our goals in this bill and this bill gets passed, we will not be able to revisit our issues for a long time. So right now a lot of the attention is being given to it. This does not mean that BEC is forgotten. Hope you do understand.

It shows that the interpretation of law is not same everywhere.
some people get it easily and some dont. Bridgeport, CT DMV is very crowded most of the time and tough to get things done. There are a lot of people of a kind that come there and it is tough. you must try Westport etc kind of areas next time.
yes, there was so much difference between Bridgeport and Hamden. Eventually I got it for 5 years though I had just 1 year extension on my H1b. I am now in NYC and have to get NY license and just to play it safe , am planning to get the license when I get my h1b 3 year extension which will be applied sometime beginning next year.

I heard from some of my friends that places like Detroit downtown,Arkansas,St.Louis,Tennessee, Louisiana are deadly dangerous. How far this is true?
my friend, pretty much every place in US in unsafe.
from the news: "The motive behind the killing is not known but Murthy, an official of the state-owned Bharast Sanchar Nigam Limited (BSNL), quoted Vishal's friends as saying that some African Americans shot him after an altercation. "
Not to disrespect the read, but people should realize what they are getting into before they get into arguments or brawl. This is not India.

ivslave,
I did ask my friends but only thing I didn't poll it on IV.
Bottomline is with so many people waiting for their GCs. residency, H1-B other status in IV...the last thing in their radar is a poll on buying a house.....
My friend circle was enough for me to decide on such things than the hapless and ever-patient members of IV. Give them a break..........

Nancy Pelosi has long talked about her first 100 hour agenda and immigration is not on it. It would be amazing to see any immigration talk in lame-duck session.
Although, it would be a good start because both parties agree on it but I don't think the strategic think-tank in either party will rush to do that before seizing each other's deeper 2008 Presidential agenda.
Lets chalk out a strategy for next year, which is the Chinese year of the PIG.

FBI Namecheck status (not good news) (pg. 37 of the report)
As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year over a 44 percent increase in the number of cases pending more than 33 months.4

A good delaying tactic. In reality to implement such a proposal they might takes years to come up with a methadology and then to implement it. In the mean while all EB immigration bills can be kept on hold while the points system is being "evaluated"

I am a Chemical Engineer ( 16 years in India as a Senior Guy + more than 5 years in US )
I am a founder team member of a high technology advanced material company, created with the help from a VC & active support of local congressman. We literally reopened a closed factory in Ohio to start this R&D / manufacturing company. ( Politicians have been making a lot of noise to revive manufacturing economy in Midwest)
We have hired about 18 people till now & we are NOT an IT company
I was accorded honorary citizenship by the mayor of city of Clinton, MS in 1989 for my extracurricular activities but did not move to US untill 2000
For last five years I have been through this immigration circus & had to file L/C multiple times. Currently, I am not able to file I-485 & I am in my 6th Year of H1-B

Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.
it is required by law. if lost in mail, then you have to do special documentation with i 140

desi3933,
May be you're right. for the benefit of the others, can you provide more info, and any basis for your statements. This would be useful information to have for a lot of affected individuals. Is there any reference to INA or CFR that one could look up?
the following are desi3933's comments:
- sertasheep:Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
- sertasheep: Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.
- desi3933: 3/10 year ban applies to unlawful presence only and NOT for out of status. If I-94 date is passed, only then person starts accumulating unlawful presence. There is a BIG distinction between unlawful presence and out of status.
Yes, there is a distinction between if the I-94 date has expired, or if it is valid
Sertasheep -
Here is a link that has details about both both Out of Status and Unlawful Presence. Please note that 3/10 year ban applies only for Unlawful Presence case only.
http://www.immigrationlinks.com/news/news729.htm
As per memo -
Aliens Admitted Until a Date Certain: In general, an alien admitted until a specified date will begin to accrue unlawful presence either:
* when the date on the I-94 (or any extension) has passed, or
* if INS or an IJ makes a finding of a status violation, whichever comes first.
Not a legal advice.
