All,
My wife and I applied for EAD together almost 110 days back. My EAD came through within 60 days but no signs of any progress on my wife's EAD.
Are more of you facing the same issue? We called USCIS and the officer expected another 3-4 month delay.
What are our Options? I thought USCIS had a commitment to send out EADs within 90 days! Any idea why the interim EAD thing was dropped? Any exceptions under which they actually give interim EADs?

here is what i suggest:
create a yahoo group or blog..and have ppl publish the name anonymously of the desi bloodsuckers...some kind of activism is required..instead of coming on this board like some ballless buggers and crying like babies...grow up and take back ur life...bytch..;-)
btw..i am not in IT so..i dont have to deal with suck suckers.. i have read so many posts abt this.. i am fed up..

As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.

H1B expires Nov 2010.

500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?

yeah.. So another reason to keep looking at the visa bulletins now. Once i get a GC I buy a house and get a gun. The american dream. ;-)

If you have kids then its easy to move to India before the Kid goes to 2nd or 3rd grade ie before they are 8 or 9 yrs old. After that there is no way you can take a kid out of school in US and expect them to be competitive in India.
This is based on US public school system standards (if you are homeschooling its different). I had friends when I was in India who had lived all their lives in Middle Eastern countries and even though they had studied in Indian system they felt it difficult to compete there.

It failed because low-cost manufacturing took flight from Mexico to China and similar scenario for software from US/Canada to India. This trend is not going to reverse in next few years. Service sector already accounts for 40 to 50% of Indian GDP and will keep growing. Based on these facts it is obvious that long term economic prospects are better in India/ China, since you are looking from your children's perspective.
Also, you mention issues about Indian education system. I disagree. There are problems with American education system also. You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.
One last thing about issues. It would be good to let your kids decide what skils they are interested in learning, most Indian parents live their own dreams through their kids. Just a suggestion :)

1. If one has not applied for EAD and TD , one applies for them and wait anxiously for their receipts.
2. Meanwhile some people start getting FP notices and one does not receive them he or she gets anxious. Finally one gets FP.
3. Meanwhile one gets the receipts for EAD, TD. One keeps checking the status online.
4. One goes and gives finger prints for INS.
5. Finally one gets his or her EAD and TD after 5 to 6 months , One enjoys the moment briefly.
6. Its almost a month since one received EAD and AP , Its time to apply for renewal.
7. Repeat step 1
8. Its almost 15 months since the first FP and one receives the second one because "Finger prints expire" ,
One has to repeat these steps in a cycle for almost 6 to 10 years depending on PD and "Nationality"
Meanwhile if USCIS changes any processes anywhere in the pipeline expect further delays.
I think best thing is to do participate in IV activities.

I find it hard to digest why would they mind if some one has been to India recently?
Does this argument apply just for the indians or does it apply to individual of any nationality?

For those who are attending the event, it would be beneficial if someone could provide some tips about moving around DC area/Capitol Hill area for these lobby days. Will there be an IV arranged transportation ?
Appreciate if we could get more details about the planning for these three days.
We are going to be posting FAQs soon on IV website. People who have confirmed their participation will also be contacted personally. Please also check with IV co-coordinator (Starsun) if you have specific questions or write to info at immigrationvoice.org

If not expunged, it will FOR SURE pop up immediately they punch your name in. You certainly can not lie there. You will be deported. If expunged, you still have chance BUT NOT to lie..If the form ask " If you have ever been arrested" say yes and as others suggested have all your documents ready from court but make sure you have all originals and notarized documents if required for all court orders pertaing to your case.

I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
However, this shouldnot encourage you to be dishonest at POE's or visa interview.

You can apply H1 extn earlier than 6 months. Mine was expiring in Sep 07. I applied on Jan 5th 07. Got 7-8-9 year extn in March.

Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!

Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
If your labor was filed after Feb 07 (since your H1 expiring in feb 08) and your I-140 does not get approved by feb 08, then EAD is the only option to be in status, (unless u join Patni, TCS, wipro, Infy on L1 :-)

If you look at THOMAS it actually shows that Yeas are 55 and Nays are 40
So the bill passed the voting ....
but it failed because it was ruled "out-of-order" and hence rejected ...
I dont know why it was ruled out of order ... maybe because it was attached to the defence spending bill so it was not the right place to put in this kind of amendment....
I hope that Yeas mean YES and Nay mean "NO" or I need to get my head examined
