I ask the doctor to treat me first but also make sure that my brother gets treatment too. It's just that for the past 15 days not one post reg people stuck in BEC's and one guy who started the thread of unfairness got bashed.Even then no announcement nothing from the core team. That's what bugs me.
I'm not trying to create a division. In fact I sympathise with everybody effected by VB ,all the money, effort, time that you have put in.I know I'll be next in line waiting to get in the roller coaster.I also know that core team is not answerable to anybody.
Peace..

I'm not expert in advising but murthy.com is saying avoid duplicate filing that may lead to rejection. Would suggest to consult v.good attorney before you do.
I have seen that on murthy too. I am not sure why they say that. Anyone else who ever submitted multiple AOS applications?
I am sure people have submitted two separate apps in cases such as:
1) both husband and wife working and eligible to file. One app submitted with husband primary, wife secondary AND the other app submitted with wife primary, husband secondary
2) AOS for old labor + AOS under PERM
In both cases I believe the USCIS will ask you to choose between the two when the time comes.

If ya'll do like a character model contest next time, I think I will be in. But we will need like a 4 week due date...lol. Good job all.
Sounds good 3d, I'll actually look toward a battle like that.
It'll be my first character project, but I'll be looking foward to it.

I understand your situation because you had posted elsewhere on exactly what happened to you.
Premise of the Green Card (and H1-B for that matter) is that an American citizen or a Permanent resident was not available with required skill sets for the work to be done.
Scrutiny at H1-B was traditionally a lot relaxed because it is temporary in nature by definition. A lot us seem to assume that Green Card is a natural progression from H1-B. In Employment Based GC, burden of proof lies with the organizations. I have worked with small and big organizations, and I am yet to come across an organization that will go out of the way or makes exceptions to an employee at the risk of its reputation or facing legal hassles.
When I had a choice to make may be 5 years back, a friend of mine advised me. If you have GC, big corporations can employ you easily, but if the big corporations employ you, it is not easy to get GC. (particularly because the HR would not be so easily accessible, but "control" is what he was alluding to.)
I took his advise, and landed a "desi" company, which was not so "desi" in its thought process and treatment though. They were flexible, at the same time, great to work with, paid very well and took care of expenses at actuals. I was lucky enough to have landed where I had.
One has to know very well, what one wants to do and where one one wants to head. If the over-riding factor is a GC application, find out where you get the flexibility. On the other hand, if an over riding factor is a satisfaction to work with big name companies, then you know how it works. No point blaming companies.

I posted the following details in other thread -
************************************************** *******
Here are the options to fly back to your home country:
1. Fly directly to your home country - No transit visa required and no valid US visa required
2. Fly via any other country - No transit visa required as long as you are not stranded in airport due to delay in first leg of the flight. Also, to board a plane to Europe you have to have a valid US visa.
Here are my past experiences:
1. I had a valid US visa and I was traveling from Cincinnati to New Delhi via Paris on Air France. My flight from Cincinnati got delayed and I missed my connecting flight in Paris. All the passengers that had the green card or US citizenship were allowed to stay in Hotel outside the airport. But, since I am an Indian national and did not have a transit visa, France custom officer told me that I am "illegally" in France. He was nice guy and advised me to stay the night at the airport terminal and board the plane to India next day.
2. My US visa on my passport expired and I had the H1 extension papers with me. I was traveling on Air France from Cincinnati to New Delhi and my flight was via Paris. The airline staff at Cincinnati did not allow me to board the plane as I did not have a valid US visa on my passport. I had to drive down to Chicago to get the transit visa.
3. My US visa on my passport expired. I flew directly from NY to New Delhi on Continental. No questions asked.

There is going to be no spillover to EB2 India at all because according to the thread "Employment-Based Visa Number Movement and Predictions - from current Murthy Bulletin" thread Mr. Oppenheim (the guy from the DOS who sets the visa bulletin) said that EB1, EB4 and Eb5 might also retrogress (that is have to a cut off date which means they will not be current). If EB1, EB2 and EB5 retrogress and there is no spillover from EB2 ROW and there is no spillover from Family based visas there will not be any spillover to Eb2 India at all. There is absoluetely no difference between Eb3 India and Eb2 India except that EB3 India will be stuck in 2001 and Eb2 India might be stuck either in 2002 or early 2003. We are screwed for ages to come. Dont give me red for bringing this harsh reality, I myself am depressed
Nobody should get red for expressing their thought!! So if at all I give you some, it would be only green!
coming to your point: Even in the thread you referenced to, I have posted a comment "Mr. Oppenheim's statements do not add up...his statements logically contradict each other (well you can not expect LOGIC from USCIS). and so the exact scenario will only be clarified with VB, date movements and finally, their year end statistics".
Accordingly, moving the EB2 I and C together, they have proven that "they are getting ready to spill over". Moreover, EB2 China has used up "its own quota" and will need spill over to move. EB2 ROW on the other had has not used up "its own quota" and will not need spill over (as it is current and not together with India and china). So any spill over from EB1 will come to EB2 India and China (effectively only to India). And if EB2 ROW does not use up their remaining numbers (which they have not so far) during the rest of fiscal year they will also spill to EB2 India.
Now as far as future of EB2 vs EB3 is concerned, I personally believe (and this is just my personal belief....) that unless EB1 (specially EB1C) gets oversubscribed (as mentioned in other threads), EB2 should move quickly during next fiscal year. EB1 usage can only be known from year end data as and when they publish it.

Porting from Eb3 to Eb2, at first glance looks like advantageous to remained lot of EB3 as it seems to be shortened the queue but one factor spilling over from ROW to EB2 first w.r.t EB3 kills that "virtual" advantage proprtionately (if not 100%).

You can also use Mental Rey, and check the "final gather" option. Make sure when you use it you set the rays down to like 10 or 20, or it'll take forever to render.
This will actually make all objects emit a certain amount of light depending on their brightness. For example, a stone wall will not make any noticeable light, but a bright white ball (a light bulb) will act as a omni light. I use this in almost all my renders to achieve a more realistic scene.
That shader glow thing isn't what he wants I think. To add it though, open the attributes of the material, and under the special effects menu you just increase the value from 0. That does not make the object a light though, it adds a glow to the object in post (after the render), and so it does no make any actual light. .... i might be thinking of some other glow thing, soulty's way might work as well
I will start my subway soon guys! I love the entries so far! Keep it up!
Cheers!

yeah I've known about the glow effect, and thats not exactly what I'm trying to acheive. But thanks for the mental ray technique, I'm gonna try it!

Sens. McConnell & Lott on verge of passing amnesty -- unless you get in their way
THE U.S. HOUSE TODAY is dealing with many important immigration matters as it amends the Department of Homeland Security appropriations bill. Your NumbersUSA Capitol Hill Team is following this closely. You can follow all amendments and votes on our special VOTE DAY page. We update at least by the hour. If you see something you want to support or oppose, don't hesitate to call your U.S. Rep.
TO BEST FIGHT THE SENATE AMNESTY, read Rosemary Jenks' short summary of all the key elements of the S. 1348 Bush/Kennedy amnesty bill as introduced. Scroll down to BACKGROUND INFORMATION.
Read short descriptions of all amendments the Senate has already passed to modify the bill. Scroll down to FINISHED VOTES.
Friends,
I regret to tell you that our victory of last Thursday night has eroded to almost nothing by this morning.
Senate Republican Leader Mitch McConnell of Kentucky and Senate Republican Whip Trent Lott of Mississippi have succeeded in twisting nearly enough GOP arms to assure Sen. Ted Kennedy (D-Mass.) that they can deliver the votes to pass his S. 1348 amnesty for 12-20 million illegal aliens.
Here is the pitch that McConnell and Lott are said to be using -- and the pitch that only you can persuade Republican Senators to reject:
Lawmakers are being told that they must agree to vote for cloture on the amnesty in exchange for a chance to have some favorite amendments brought up OR they will lose a chance to "sit at the table" in final fashioning of this bill.
A senior GOP leadership aide confirmed that anti-amnesty Republicans are being told by Party leadership that they “need to get on board if they want to remain relevant.”
I have some actions related to Democratic Senators that I'll detail further in this email. But our most urgent work today is with GOP Senators.
NO MATTER HOW MANY TIMES YOU HAVE PHONED IN THE LAST MONTH, YOUR PHONE CALLS ARE DESPERATELY NEEDED TODAY.
CALL SENATORS IN D.C.
202-224-3121
(If you live in Mississippi and Kentucky, I've already sent you your action opportunities. You have to take responsibility for the two Senators who at this moment are competing for the title of America's No. 1 and No. 2 Enemy. I am sending this alert to you so you have the additional information that is in it.)
TELL GOP SENATORS TO REFUSE 'A SEAT AT THE TABLE' AND TO REMAIN 'RELEVANT' BY PROTECTING THE WORKERS AND VOTERS OF THEIR STATE
Call their offices and tell them you have heard of the 'take-it-or-leave-it' deal they are being offered and that your advice is:
"Refuse a Seat at The Table If All They're Serving Is Rancid Mush."
Tell them that permanently legalizing 12-20 million illegal aliens and giving them permanent access to our jobs is a dish not worth fussing over. No amount of seasoning or ingredient changing can make this dish palatable to the voters of your state.
Any amendment that would truly protect Americans would be killed by the Bush/Kennedy coalition.
No matter how many amendments are allowed for votes, the end result bill will be terrible -- maybe slightly less terrible than now, but still terrible. There is no point in trading away a YES vote on cloture for the chance to offer an amendment.
You must make it clear to every one of these Senators that they will be made to pay politically over and over the next year (maybe their whole careers) for a YES vote if this bill comes up again on cloture.
Remind them that Sen. McCain has seen his front-runner status in the Presidential primary race plummet because of his highly public support for this bill.
Why would any of these Senators want to carry around that same kind of baggage?
And tell your Senators that they have all the "relevance" they need by being the representative or your state in the U.S. Senate. They don't need George Bush or Karl Rove to give them relevance, especially if relevance has to come at the expense of principle.
EXPOSE AND CHALLENGE THE LIES THAT POLLS SHOW AMERICANS SUPPORT THIS AMNESTY
Yet more news media polls are being released purporting to show that the majority of the public supports this Senate amnesty bill. The big use of these polls by reporters and open-borders advocates is to supposedly prove that all of your phone calls are just a loud-mouthed minority.
The fact is that nearly all the media polls fail to offer people the choice of Attrition Through Enforcement.
When Americans are offered a choice between legalization, attrition or mass deportations, most Americans choose attrition. And an overhwelming portion choose either attrition or mass deportation.
You can find great backing of what I just said by going to our web page on polls.
OUR ARMY IS GROWING -- Let's Hold Back Disaster While We Recruit Another Army of Reinforcements
I hope you feel encouraged to know that another 4,081 Americans registered with NumbersUSA and immediately began faxing and phoning -- that was just yesterday, one day.
Day after day, the word is getting out. More and more Americans understand that they must take real action if they are to save their American quality of life.
We started the year with around 250,000 activist members. Barely a month ago, we hit the big 300,000 milestone. It looks like we will hit the 400,000 mark tomorrow!
In addition, we have a total email list of more than 1.5 million now.
Unfortunately, not everybody who connects, becomes a direct activist with us (although we assume they are having some influence among their friends and colleagues). And not all who register as activist members respond regularly to our Alerts. We know we probably need to have 2 million activist members to ensure that 500,000 are acting at any point. This is true of any organization. But we appreciate every one of you for whatever you are able to do. It all adds up to something strong.
Numbers of faxes you ordered the last two days:

HOLD ONTO OUR DEMOCRATIC ANTI-AMNESTY VOTES
It is imperative that we hold onto at least 9 of the 12 Democratic and Independent NO votes we got last Thursday on the cloture vote.
Phone these offices and urge them not to be taken in by the Republican leadership's pandering to Big Business lobbyists who are demanding to keep employing their 7-million-plus illegal workers and are demanding an amnesty for all the lawbreaking by the outlaw companies in the past.
Tell these Democrats that they are standing with the American workers on this and should be proud of their principled stand against Pres. Bush's dream of globalizing the American labor force.
THE 12 NON-REPUBLICANS WHO VOTED AGAINST AMNESTY LAST WEEK
(* Up for re-election in 2008)
* Baucus (D-Mont.)
Bingaman (D-NM)
Boxer (D-Calif.)
Byrd (D-WV)
Dorgan (D-ND)
* Landrieu (D-La.)
McCaskill (D-Mo.)
* Pryor (D-Ark.)
* Rockefeller(D-WV)
Sanders (I-Vt.)
Tester (D-Mont.)
Webb (D-Va.)
THE BASIC MATH
Last week, 45 Senators voted for cloture. It takes 60 votes for cloture to pass, thus ending a filibuster and allowing a final vote, which at this time would require at most 50 votes to pass.
The pro-amnesty Bush/Kennedy coalition has to persuade 15 Senators who voted NO last week to switch to YES if the cloture vote comes up again.
The only thing that can keep that from happening is an even larger outpouring of phone calls, faxes and local demonstrations at Senate offices, etc.

sts_seeker, We are perfectly happy to wait "before everyone who filed earlier." If you as a Nepali had a PD in 2001 and my PD is in 2002, I have no problems in you getting your GC before me. In this situation, you have filed before me, so it is fair that you should get your GC before me.
But today with the Country quota in place, your PD could be in 2007 and my PD could be in 2002. Guess, who would GC first?
I support country quota otherwise all the greencards will be taken by Indians and Chinese and the people from small countries will not even get a chance. I am sorry but of you are born on one of these countries then you have to wait before everyone who filed earlier.

no comments on the above ?? I do support the FOIA .but when you think about it ..what is the point in knowing that our GC's are 3-4 years away ...we should also focus on something getting passed during lame duck session ..at the very least we should be prepared for something incase it is suddenly announced that there will be lame duck session after elections ...any thoughts ??
Can somebody re-post the link for downloading the form I need to fax?

I did some googling for Boston - Looks like there is a single postoffice in whole of New england ( me,nh,vt,ma,ct,ri) which is open 24 hrs and accepts mail 24 hrs... Here is the address...
US Post Office - Fort Point Station
Neighborhood: South Boston
25 Dorchester Ave
Boston, MA 02228
Pete S. writes: Ah, the lovely Fort Point Station, the public face of the massive General Mail Facility Boston that looms along the middle reaches of Fort Point Channel, and the only place I know in New England that you can conduct mail any time, day or night. That's right, this post office is open 24 hours. Need a postmark of that day at 11:30 at night? You got it. The 15-minute parking lot is a great way to drop someone off at South Station, to which this post office is connected by a hallway and outdoor walkway.
It is possible for every city to have at least one usps office to be open on Sunday. They have a different day off.
Just go to the USPS website and locate an office that is open on Sun.

One of the main reason for EB3 in 2001 is From 2000 to 2003 they increased H1b from 65 to 180K. Most people came those time was BA, BSC and B TECH. So most would have applied by EB3 and also from 2000 more than 60% of H1bs were Indians. It may take a few more years to clear 2001 to 2003. But there could be some spill over from Eb2 in 2 years time. So from 2012 Eb3 may move fast. Still 7 to 10 years waiting period may not change unless some bil or CIR is passed. But it should be noted that H1B Cap applications received this year is around 13500. So past 2 years slow down will make PD to improve.
We are looking at Annual Report of Immigrant Visa Applicants - http://www.travel.state.gov/pdf/WaitingListItem.pdf
On Page 1. - "The petitions of applicants who will be processed at an overseas post are forwarded by CIS to the Department of State"
Our Interpretation: As USCIS processes I140 Applications, and I140 Applications has Field for Consular Processing options, they would Direct those Applications to DOS Via Above Process.
Question:
Are this Numbers are total VISA demand recorded at DOS?
Anybody other Views?

Delhiguy,
YES! They did broke law by provisioning visa numbers for applications that had not cleared FBI check. Their book clearly says the visa number needs to be alloted only after the application is 100% ready for adjudication.
Yes, this is another one. There are somany. Please check AILA lawsuit.
