After nearly 15 months, going by recent postings here , I was tempted to call IO to get any update on my 'pending I-485' . I happened to talk to a nice IO on my first attempt. She took some time to check on status and told me my 'name check is pending'. I told her on previous occasions / Infopass I was all the time told 'everything for me, especially name check is cleared'. She came out with an explanation---- your 2nd FP was cleared on 17 July 09 (Yes, I had 2nd FP on 7/6/09 as Ist FP in Sept 07 'expired' after 15 Mo validity) and that is why new 'name check' is initiated.
I can not believe this. If this is so, they may have to wait for 180 days even if there is nothing adverse from fbi and the dates become current.
It is very creepy.....
Please, share your thoughts if uscis require NC again and again for this never ending GC process ..
I called them several times yesterday until I was able to get hold of a good rep. Most of these reps are rude and they dont even care to listen to what I was asking.
The "good" rep told me that my case has been pre-adjudicated in the month of April and everything is all set and that they are waiting for the visa number. He said I might be getting another FP if it takes too long, but other than that everything is set. He did provide me quite a bit of information about my case, he told me that my name check and also background verification is also complete. He was even able to tell me how many EADs and APs have been issued to me against my 485. Hope this helps.

USCIS memo dated Jun 12 2008 says
I filed my Form I-765 more than 90 days ago and I have not received a decision, who should I contact?
If you have not received a decision within 90 days of the USCIS receipt date and you have properly filed your EAD application, you may apply to obtain an interim EAD by appearing in person at your local USCIS District Office. You must bring proof of identity and any notices that you have received from USCIS in connection with your application for employment authorization.
Mine expires OCT 3rd. Applied Jul 3rd, FP Jul 31st. No LUD , No News since

All,
The object of this thread is straightforward - it is to understand if you as a donor member will contribute more $ (or start contributing!) if you get more regular information updates (weekly?) from Core? I know there was a funding drive in March which led to us meeting the goal of $10,000 (and then some). However, while there has been a new goal of $10,000 created for April, we have made little progress towards that. As someone who contributed $100 the first time round in March, but haven't yet made a contribution towards the April funding drive, I can admit that one of the primary reasons for this is because there has been very limited information shared since then. While I COMPLETELY trust in the fact that the Core team is making every effort humanly possible to further our cause, I am also a member of the human race that by nature seeks information and looks for leadership to be more sharing about progress. I personally believe transparency is a key enabler not just to gaining participation and building momentum, but also to creating innovative solutions to problems by engaging more individuals in the process (borrowing this "leaf" from President's Obama's playbook will be highly beneficial to our casuse)
Let me clarify this is NOT an indication of lack of trust in Core NOR do I believe that there isn't a sincere effort being put in by a whole bunch of dedicated individuals. However, my suggestion is simply an idea to further the cause - would definitely like to hear how the rest of this immigration community feels!

I am sure he has heard of IP hiding techniques. If I were banned based on my IP, and I consistently want to post dividing threads on IV, would I not use a hidemyip plugin or post thru one of the hide my IP websites?

Dont give him ideas. I wouldnt ban based on IP as I know many guys from same company can be members of IV. We dont want to ban all of them.
Second, I would not ban him, instead make him part of us for a collective action. He seems to have a big group and they are planning to do somethings in which we have interests too. If his agenda if fully like those of IV or mine in my thread, then its not a bad idea to do something rather than waiting for a shubh ding for EB3 to become current or move drastically. I see no hope unless we raise our voice together.

Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.
So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

But is really important to SAY THAT�S MASTERS DEGREE PREFERRED,
Because I have Masters in computer science but the job requirement does not need it.
To apply in EB2? Or just BS+5 years of experience is good enough

I am planning to send a letter to President, First Lady, DOS chief besides other Govt. rep. Anyone has the addresses?
I am in CP and I am writing to them to allow CP filers who are already working here in the US to file for AOS (even if the PD is not current) anticipating a very long delay for EB3 I. That way we could get atleast the minimal benefits like EAD, AP.
If any CP filers from EB3 I wanna join me, more than welcome!

OKay, when I commented on the English, I was trying to be funny (which obviously I am working on) and see if that can help you in the misinterpretation angle.
Also, when someone does not support your theory, he/she is actually supporting you, by letting you know that your theory does not sound reasonable.
Contact a Taiwanese/Asian lawyer and ask him to help you. You can add him as a lawyer, and even if you are replacing your lawyer, and if asked, you can claim language barriers with the old lawyer.
And no, we are not experts here, and no one has claimed to be one, but I believe the real purpose of yours posting your situation here was to have ideas. There are thousands of thoughts going thru your mind on this situation and you are definitely not able to see thru clearly.

Firstly I am not from India where most of your guys come from. Instead from Taiwan 2 and half year ago. As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Just kill the time???
When cops knock out your room, handcuff your hands on the back, force you stay down at the corner , if you could keep calm and state very clearly. I can only show my respect but unfortunately I did not make it. This is my first time. :( Should be the last time either.
Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. I knew you all have better english than me. so you could explain clearly :) But Same level, do it on your spouse is even worse on a stranger.
I create this thread just wish listen your opinion and try public view how much chance I can win the jury trail. Some of your advice is really helpful and I will take them.

Employment Third Preference Other Workers Category: Section 203(e) of the NACARA, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.
B. DIVERSITY IMMIGRANT (DV) CATEGORY
Section 203(c) of the Immigration and Nationality Act provides a maximum of up to 55,000 immigrant visas each fiscal year to permit immigration opportunities for persons from countries other than the principal sources of current immigration to the United States. The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This reduction has resulted in the DV-2011 annual limit being reduced to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.
For April, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. Entitlement to immigrant status in the DV category lasts only through the end of the fiscal (visa) year for which the applicant is selected in the lottery. Similarly, spouses and children accompanying or following to join DV-2011 principals are only entitled to derivative DV status until September 30, 2011. DV visa availability through the very end of FY-2011 cannot be taken for granted. Numbers could be exhausted prior to September 30.

I applied for FOIA on my 140/485 petitions and I have got scanned copies of the file. It took more than an year to get the copies.
To my surprise and disappointment, 140 approval notice was not included in the copies they have sent.
Can we get the copy of I-140 Approval Notice under the Freedom Of Independence Act (FOIA)? If so, please advise the way to do it.

My dear Mr. smuggymba -
for your kind information, sorry for starting rats comparison here but I came to US about half a dozen years before you. my priority date is 2006 and EB3. also I recognize that there are ppl out there who came earlier than me too. Its very easy to preach 'Life is decided by choices we make', 'your luck/fate, success is decided by your own effort, talent', 'if you have it, ppl will notice it and you will succeed' etc. when you spend the most energetic, productive part of your life in a country, you would expect that country reward you with atleast opportunities to prove your mettle. not to say its immensely painful when ppl who came years and years after you get GC and grow leaps and bounds right in front of your eyes.
P.S. I am not questioning your qualifications or anything.
Just chill man. You're the one who was calling GC garbage can and then spending your most productive years on garbage can. Who spends his most productive years on garbage can? Obviously GC is something bigger for you.
Anyway, best of luck and have fun with familiy. Don't take too much stress...hopefully Obama will do something and everyone will have GC in 2-3 years. chill. assuming you are serious about the house ..I can say this ..with your PD and category it makes more sense to rent a house for a year and then decide yourself.
with a house you get lot of space, independence but with significantly high costs, maintenance and loss of mobility. plus you end up buying far away from your work ..so family time is lost during weekdays.
in apartments - you end up saving and investing more in retirement accounts, children education accounts etc etc ..but the flexibility is priceless...also greater chance of your kids making more friends in apartment parks / play dates etc.
so renting a house is a good bet if you really really need space ....home prices will decline for many more months in most locations and will be stagnant for years when u take inflation into account ..
