With all due respect asking Bernanke to increase visa numbers of to do visa recapture is like asking a very successful lawyer to do a by-pass surgery.
Congressmen (senators included) make the law and President signs it into the law. President is also the head of executive (which includes USCIS), hence he is the boss of USCIS. Its basic civics 101.
Even if Bernanke is convinced 100% about your points, there is nothing he can do to help us. He doesn't make the laws, and USCIS has no reasons to listen to him (he isn't their boss). So what you suggest, my friend, is that we bark up the wrong tree, instead of approaching the right people - who are the only people who can fix our problems.

Congrats to President Obama.
But, I don't personally agree with the selection committee's decision which suprised everybody including the President. The peace prize should go to someone who have had a track record for working towards achieving peace or the greater Good. They never gave one to M.K Gandhi who deserved it more than anybody in this world.
Make no mistake, Mr. Obama is a messenger of peace but, the fact is that he has been awarded prematurely for something he is yet to achieve in terms of ending the wars, ending nuclear armament, mid-east peace agreement etc (even though I think he will do so in the future).

That's why we couldn't solve all the admin related issues then. If we had significant volume, we could have had visa re-stamping done in USA and the list goes on.. Any ways, I don't mean to give numbers.. But as long as we are on the same page that volume speaks and we don't have enough at this point of time, I am good.
We need a mass movement to make an impact. They need to get frustrated with the letters and will have to give a press statement that they are reviewing the matter. As long as we can do that. I think we can get DOJ attention. If 5K members send letters 10 times in 2 months, I have no issue, as long as we can annoy them with letters for justice..
Maybe if we can repeat the flower campaign, and send the flowers with a note attached to the DoJ, they might get to notice it. Or, we can send the flowers to the president to appraise him of the issues that face us. What we do need to stress is the fact that dependents are being allocated immigrant visas that actually belong to the employed applicants, thereby creating a larger backlog. In effect, rather than 140K visas being issued to employed applicants, about 70K are being issued and the rest going to dependents. any thoughts?

it may be so in some scenarios - but i'm not sure if thats the rule rather than the exception. but then again - i'm speaking from my limited experience in this area, which does not include a consultant position (have always been a full time employee), and could very well be wrong about how this works in the consulting world.
my intention is not to preach - just bringing up what i've been told and have read on IV regarding the letter and spirit of the law around filing - and that the OP should be aware of this before deciding on a course of action.

Sorry to hear that your 485 is denied....
My question to all the gurus here...I wonder what happens to EAD and AP after you appeal 485 denial?
I know that if your 485 gets denied then EAD and AP are void but lets say OP files 485 MTR(motion to reopen), does he have to reapply for EAD and AP or does that get reinstated based on the reciept he gets on 485 MTR?
Should the person stop working till he gets 485 MTR receipt or till he reapplies for new EAD and gets the approval?
Just curoius to know as these days denials seems to be the trend at USCIS and it would be helpful for all those who rely on EAD only and not sure what to do when there is a 485 denials for what ever reason.

You do NOT have to apply for another EAD. You're safe to go back to work as soon as you receive your MTR receipt. It is not the case that when the reduce H1b they need to outsource. Can any statitics tell that last 3 years H1b cap reached but because of that Outsourcing is done or US lost Compettiveness because there is no skilled workers. No evidence proves that. Still US only is having most technology companies.
If US lose 12 million illegals that will cause a problem for employers. But if 50% of H1b people leave the country because of green card issues then same or more number of people will enter by H1 or L1 or b1. That is the reason Skil bill was not able to pass in the Senate based on the fact that some abuses are in H1b. Skill bill can be delayed 5 years but impact will be less for the country. But impact will be more for immigrants. Also now H1b can be extended unlimited number of times when I140 is cleared. So really exodus will be very less compared to incoming persons. So there is no compelling reason for the country to increase gc. But for illegals there is compelling reason to act on them because illegal immigration will go uncontrolled if they leave as it is.

I am probably waiting for the longest here for EAD, my app received on July 2nd at NCS. Called numerous times, sent form 7001, emailed senators twice, 3 infopass appointments, still no progress. I submitted expedite request based on humanitarian grounds last week, have been calling daily to check status of expedite and still remains pending. My case now pending about 157 days. Anything more that I need to do ?

My wife received EAD on 10/22 and so far there has been absolutely no update on my LUD and EAD application is still pending. The service center is Nebraska and I am the primary applicant. I think there a a lot of people in the same boat.

I totally understand that reporters may skew facts to their specific needs and know first hand that the EB-3 category is retrogressed across all nationalities. I am one of your members that is not from either background mentioned.
I was responding to a post on this forum (and not the press in general) that implied that this issue affects people from specific ethnic backgrounds, which is false.
I do have a general issue that people seem to forget that.
I applaud all core member efforts, however negative this post seems.
