    AFAIK they dont know unless USCIS issues an RFE for tax returns. What was her status before she filed her 485?
    Also why are you concerned whether they know or not?

    Before that she was on H-4, I am still on H-1B

    I have an issue with my I-94 and need your advice on this.

    I came back to US from India vacation on 10-Sep-2007. My H1 Papers from Company-B got approved(on 5-Sep-2007) just before I start from India . So I could not show the new Company-B h1 papers at the Port of entry to the CBP officer. I got my new I-94 date based on the old Company-A H1 papers which is valid till 30-Sep-2007.



    I red on the Immigration Forums that USCIS follows last action rule to determine the validity of I-94. In that scenario, the I-94 that comes with my new H1 paper gets invalidated. If it is true, am I out of status after 30-Sep-2007?


    Could you please advice on my possible options on this issue?

    As many regular readers of this blog know, I am impressed by the amazing work of Vivek Wadhwa, research associate at Harvard, and an entrepreneur in residence at Duke. This week his most recently published article, The University Of Competition (http://www.outlookindia.com/full.asp?fodname=20090622&fname=GCol+Vivek+Wadhwa+(F)&sid=1), in Outlook India, points out the obvious--"with its flawed immigration policies, the U.S. has exported part of its economic stimulus and is providing a windfall of premium talent to these countries (India and China)."

    Vivek also appeared in a NPR's Marketplace segment on how sophisticated engineering jobs are disappearing from the U.S. and moving to India (http://marketplace.publicradio.org/www_publicradio/tools/media_player/popup.php?name=marketplace/pm/2009/06/17/marketplace_cast2_20090617_64). The report by Janet Babin starts with an unemployed Silicon Valley engineer and ends with Wim Elfrink � Cisco�s Chief Globalization Officer who is based in Bangalore. In that piece, Vivek discusses how the world has changed and how companies now need to be near growth markets.

    This pieces and other recent pieces show that plodding ideas about commissions and study groups to recommend visa numbers are relics of a past age. The question is, will Congress act quickly enough on immigration reform to actually make a difference in helping our economy recover. Every immigration lawyer knows these simple truths--lazy people do not walk across the desert. And, its corollary--the Hope that is American attracts those willing to work hard to succeed. Well, the former principle is still true, at least for now. The latter is giving way to hopelessness--backlogged visa numbers ("encased in amber"), and a growing and vibrant economy in China and India. The failure to act quickly is going to cost America in the long run.     All,
    I am a little confused. I just got my H1B extension done recently and my attorney sent me a letter saying that if I go out of the country for stamping I need to make sure my Passport is valid beyond the H1B period.

    My passport expires in May 2008 and my current H1 is valid till July 2010. Does anyone see any issues in going for stamping in India in July 2007 with my current passport and later on some time next year applying for a new Indian passport.

    Your passport should be valid atleast 6 months from the date of stamping. So I think you should be okay. Also, its better to apply for a new passport 6 months before your old one expires. And once you get your new passport you'll have to carry both your new and the old ones as your old one will have the stamping till July 2010. Hope this helps!

    This thought occured to me this morning and wanted to bounce off. Feel free to trash it if it is not practical.

    I have seen somewhat lukewarm response to Fund raising and I feel there is potential to multiply the effect.

    If there is a way for IV to match up clients and IV members for part time efforts and the revenue going to IV, I think it will have bigger impact in terms of fund generation.

    How it can work?

    Assuming core team and extended leadership team at IV has networked into the Industry, it can get pieces of work carved out. These deliverables are those that can be collaborated on, worked on remotely.

    These need not be necassarily in IT. It could be in advertising, acocuonting, graphic designing etc.

    IV will seek volunteers interested in participating in this initiative and build skills database and try matching up with the services required.

    All the revenue from such services will go to IV.

    For IVians who volunteer, besides satisfaction of contributing to the cause, industry networking is a nice offshoot.

    This may be my opinion, but volunteering is easy if it is something you do as your second nature.

    I have seen few non-profit organizations provide services for a fee. I am not sure what restrictions are placed on IV from a taxation point of view. But over time, the fund raising wing of IV could be delivering on some niche solutions. I am sure some sympathetic corporations would be supporting by providing work.

    I had to go through the same process last year. The day i went for the interview, there were 3 other PhDs with me to get their H1B stamped. It took me 7 weeks to get the passport back and for others it took longer. Calling embassy will not expedite the process. Call Department of State and ask for the update. I know its frustrating.

    Hello All,

    When I was doing my education (MS) my credit dropped drastically and recently like 2 years back it went for collections too. However I cleared all my credit card debts but it still shows on the credit report that as severe deliquencies and number of open accounts.

    Next month I'm applying for AOS - I want to know whether bad credit will have any affect of the approval or denial of the application? :mad:

    Any suggestion is appreciated.

    My passport is expiring in March. I live in NY metro . Does anyone knows the procedure to renew the passport while in the USA. Please share your experience.

    Its very easy and simple. Go to NY Indian Embassy web site and follow the procedure/process to renew passport. It takes about 1-2 weeks, after you mail the old passport along with other documents, for Indian Embassy to process and mail you back the new passport. Good Luck!
