Just some hope. But if the trend maintains then they will have lesser pinch on the H1 processs. Hopefully that will help improve GC process as well.

Could you please pm us the IP address of your machine. It will help us to diagnose the problem and/or let you know the reason. Its possible that your work environment is using NATing. So all machines from within that network will propagate the same external IP address. If you could send us your IP address at work, we will be able to diagnose the problem.

I will be going for H1B stamping in feb/March at Mumbai Consulate.
In 2001 my F1 visa got rejected 3 times because I showed that I have sister in USA.
My sister is in still in USA. Now while taking H1B appointment in form I have again to mention yes or no (for the Que do you have any relatives in USA)
What I should do? What will be the effect if I said No? Do you think, VO will ask me that your F1 got rejected because you had sister in USA? So now did she came back?
Please reply me ASAP.

As far as i know no us consulate has right to reject H1b unless u have fasle docs or involved in wrong activities. Also DO NOT GIVE/WRITE any FALSE information about you to them or in other words DO NOT LIE to them .
F1 rejection has NO baring on H1b.

Hello all,
I had my 140 reinstated in Feb-09 after it was denied back in 08 (filed motion to reopen). Last week i inquired about the status of my case since my visa category is current (VB 02/2003), I received a letter yesterday informing me that the case is out of the processing date, my 140 priority date is 12/2002. is this a mistake or my priority date has change to feb-09?
Can you please share your case details? what was the reason for 140 denial? After you filed MTR, how long it took for them to reinstate?

at port of entry the old I-94 has no bearing, keep cpies of all old I-94s and hand them over when departing.
You will have to get a new H4 stamped at the consulate and will get a new I-94 when you enter.
You can present the courtsey copy but the main documents ae going to be your husbands H1 papers as were last time.

I would go with Method 2 since you are not taking up resources having all six of the contents in memory - even if their visibility is set to false.

My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. If your name is coorect in EAD, then you should go to SSN office and
explain them , and if required re apply. You will get it changed. Remember SSN is going to be stuck to your lifetime. Hence better do the correct thing.

Normally I -485 cases are forwarded to local offices for the purposes of scheduling an in-person interview. In my case I live in New York and no way connected to FL. I am curious anybody or any of your friend�s have similar experience.

after you recieve the EAD card you have to apply for SSN at your local SSN office.the time period to recieve SSN is different in different states.i guess the minimum time is 15 business days. please correct me if I am wrong.

YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

I recently noticed the Audited Dates for PERM moved up nearly by 9 months to Dec 2009.
My labor filed in June 2009 has been in audit.
My employer is telling that that still my case is in process.
Has any body filed in 2009 and been in Audit got it approved recently?
Those of you who have audited PERMS should check with the employers as the employers may not be checking the status regularly. Please do post if you have any updates.

I have my H1-stamping and I-94 valid until March 07, My H1 extension was applied during Nov - 06, but not approved yet....In the mean while, can I visit India and return by Feb 07 ? On my return, I will still get my I-94 till March 07, but Once my H1 extension is approved it will have the I-94 attached to it till Mar 08, is this I-94 valid ?
My employer is saying that, the new I-94 that I got from my H1-extension is not valid and they have to file a new H1 OR I have to convert the H1 extension to Premium and travel with the approved H1 extension ?
