YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

I assume u r returing US worker i.e means that ur just getting ur H1B extended in that case u can choose any consulate in your home country.i recently got stamped at New Delhi Embassy but my consulate is Mumbai.
Since I could not get dates for Mumbai consulate during my visit to India even though i paid my fees at HDFC mumbai branch. it should not matter as long as u pay your fees and u r a returning worker.

You will have 10 days from day of the denial to leave the country unless you file for Motion to Reopen (MTR).
Did you try filing another H1b through another employer after the RFE?
If that is the case and if you have the LIN number then you may be able to continue working with your current client (if new employer and client etc are ok with it).
If you have all the documents to go for MTR then you can go for it. I am not an attorney but this is per my knowledge.

I want to join too as Active Duty. I applied for that.
Someone called from mavni,,,she asked for some info and processed my application. and told me that i will recieve information by mail...
what is after that?

Thanks a lot for the quick reply. I was also thinking to go for H1 as I don't have to renew EAD every year.
My wife has worked on a project and got some money on 1099. and as I said earlier that she has taken SSN based upon her EAD.
Does it mean that she has started using EAD ?
and now her H4 is invalid ?
I have got all copies of my labor, I-140 etc. and it has been more than 180 days that I have got my EAD. Do I need anything else from my old employer ?

They don't update the online status often..some time years ..i talked to IO regarding this issue..they said, they don't have enough resources ...I also suggested to make them the "Online Status Check" to "Offline Status Check " ..No worry..Lets all take oath, not to check this online...I don't do it..

You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!

I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.

I saw in other threads that some people who aplied for AP in Dec got approval on 30th Jan. So I believe you should be getting it soon.
I also applied for AP and waiting for approval, I believe I should get it in anytime between 1-2 months.
I asked same Question, whether I can travel outside after applying or after getting receipt and come back after approval. Many attorneys say its not good practise and insisted me staying in US untill I get AP Approval.
If there is no other go, I believe your wife can get H4 stamping and come back, unless she has EAD and want to start working after she comes back (Not sure if that will be an issues).

I'm going to Vancouver for H1B stamping next week along with my spouse. My understanding is that $150 is the application fee but I'm not sure if it is $150 for entire application (H1 + H4) or is it $300 ($150 for myself and $150 for my wife).

Yours will be EB1C. You can expect to get GC in 1-2 years.
If i-140 premium processing comes back, then typically within an year. (know of 2 people who got done within 8 months... EB1-India). Right now the I-140 is going to take the longest time..

It is stating the obvious to say that blogs have been playing an ever important role in creating awareness of issues and shaping public opinion; yet we've not had a good representation of our issues in the blogosphere.
The flower campaign got a lot of attention in mainstream media but we did not have a good co-ordinated effort going on in the blogging community.
As we go forward, I think we should have a communication medium so that all the bloggers interested in these issues can discuss and execute strategies.
So if you are a blogger or are interested in becoming one, please join this Google group. Hopefully for future campaigns like rallies etc. we will be able to create more awareness in the blogging community.
