Yes, the august bulletin will be showing retrogressed dates. But when August bulletin is issued in mid-July, it does not impact the petitions received in July, because the August bulletin applies to August and even if August is retrogressed until 1975, they still have to accept 485s until 31st July.

More and more, I see people posting messages containing the unspoken assumption that since the Indian E2 cutoff date has moved forward, it is likely to move forward further in the coming months. This is a false hope.
Even with a cutoff date in early 2003, the CIS has sufficient inventory of Indian E2 adjustments on file to use up the remaining inventory of E2 visas for this fiscal year. The reason that the Visa Office advanced the priority date is to move it up to the point where overseas consular posts can take up the slack left by the CIS's inability to close out enough cases and avoid wasting visas this year.
The CIS inventory of pending cases is massive. If there were no quota at all - if everyone were suddenly "current" - and no new cases were filed after today, it would still take the CIS four to five years to close out all of the pending cases that they already have in their inventory.
Overseas consular posts maintain inventories of cases as well. When the priority date for a particular case starts to edge forward and it appears that the applicant may become "current' in the not too distant future, the applicant is told to submit all required supporting documents to the post or the NVC. ABSOLUTELY NOTHING NEW HERE, everyone knows this. He is entirely silent on (a) the ACTUAL number of EB visas available for this fiscal year, (b) spillover from unused FB quota

Since the Lord Jesus has given his Judgement , there's not much we can do about the supposedly great man but talk about his great deeds when he was alive.
Apparently goons encouraged by the state started occupying the Sacred temple Simhachala lands left and right.Then after enough has been accumulated so called great man entered the scene saying govt is taking over the occupied lands ,which they started giving over to christian missionaries.Someone I know that visited their native place Visakha a month back brought this information .I was really amused all along about the helplessness of all the people like me.
Of course like many there's many more incidents that I have heard about this so called great man.Like many I'm amazed with the articles coming in the media in last few days which are oozing with this desperation to pitch the guy into some kind of fame (albeit after death)

I think this is a very good post.
To add to this:
This incident has nothing to do with India. It just happened that SRK was from India.
After 9/11 we all know security measures are tight and rightly so.
For them it does not matter if it is
1. SR Khan who works in movies or
2. XYZ Khan who is a computer programmer or a cab driver.
If the name flashes in the computers they do the required checks.
Do you feel people with Muslim sounding names are targeted more?
No wonder, it is likely. DO NOT Blame USA TSA for that. Blame Osama Bin Laden for putting innocent Muslims through this.

I guess you would get better idea if you call up Amway corporation or FTC and find out. And not from other who spend their time flipping channels and burping beer.
As far as I know there are people from US Army, NASA scientists, NFL players, pastors etc.....from different background are very successfully building the franchise business. No wonder they are growing $1.2 billion dollars every year since 1950.
Of course is not for everyone; its only for people who know the power of free enterprise on which this country is built on.
Question is whether it will work for you? Your families finances are decided by you, and not by any other people. If you do take advice from other, then you will be flipping channels and burping beer too, and it takes one big financial hit to wipe you off the slate.
If you are making millions with Amway, why are you sitting with a EB-3 PD ? Go for EB-5 :)

This whole thread is speculation, your basic assumption itself is wrong. The horizonal spill over is not a permanent policy or trend which will be practised. You should read the INA law clearly. But if this speculation makes you happy, enjoy! :)
It is a "permanent" policy. There was no change in the law. USCIS was interpreting the law incorrectly. Now they have corrected themselves with the congressional input. This will not change.

Hi,
I am in a somewhat complicated situation.
My original H-1B status began 7/1/2008.
My original I-797A states valid date of 7/1/2008 to 6/30/2011.
This was with "Postdoctoral Research Associate" as job title.
However, my department offered me a "Visiting Assistant Professor" position,
and filed an H-1B Amendment, due to increase in salary.
Because the offer is only until May of 2009,
my new amended I-797A states valid date of 9/1/2008 to 5/31/2009.
So the amended dates are "nested" within the original dates.
They plan on doing another amendment back to my original status if the need for my lecturing is no longer needed in the department.
I am planning to go to my home country in December to get my visa stamped. Which I-797A do I submit to the U.S. Embassy?
My wife is also planning to come with me.
She will try to get her visa stamped with her I-797A which as a
valid date of 7/1/2008 to 6/30/2011.
Will the embassy look at my most latest I-797A and give me a visa
that expires on 5/31/2009? I was hoping that there was some way for them to consider the old I-797A and give me the full 3 years up to 2011.
I'd appreciate it you could give me some advice.

Here is the official information on SS benefits while living outside USA.

Per this rule, Indians are eligible for SS benefits while living in India (at the time of claim), if they have lived in US for 10 years or have 40 Social security credits (That is 10 years of SS contribution.).

I have been working here for 9 years and next year we plan to return back to India. I spoke to SSN customer service to find out my retirement and survivor benefits. Being an Indian citizen, all these are available only if me, or my dependants, have a valid residing status with the US, at the time of making the application. The contribution at this point is like getting a right to work. This is outrageous.
We all have been legally invited into this country for a work, and that means the US gov should protect our legal and fair interests. It is universally true that everyone works to protect his family. Now here is a case, where I have no right to my retirement money just because I dont have a legal resident status. Whose fault is this. I already made the application 6 years ago. If my home country does not have the comparable SSN structure, then return the money back? We will pay the taxes and take the money back. Our kids need it.
I dont know what is the appropriate channel to get this fixed. This appears more like human rights violation, or abuse. I am sure there are many in this forum who are in the same boat as I am. Can someone team up with me to do more research or share your discoveries.
To the US, this is what I got to say:

If you want to protect the jobs for your people, please do it. You have every right. But please dont dump the people you officially invited to augument the workforce of your country into the waters. Before you bring in additional workers to support your companies, do necessary corrections in your immigration policies to let them in only with green card. Dont strangulate their careers. Your existing policies have been burning the aspirations and careers of a lot of innocent people from India and China.
To those innocent legal foreign workers that have already gathered 40 points in SS, you owe them. They deserve citizenship, not green card. I know it is jumping across multitude of issues, but is it not fair.

The issue is that people speak big here - but run away when asked to come forward. How do we trust 35K members who have tons of excuses for not doing anything for themsleves and blaming IV and questioning IVs credibility?

I think we can make some very credible and good arguments for ourselves.
a) The changing demographics require an increased level of immigration. It is upto this country to decide if it wants semi-skilled immigrants (Indian cooks and gardeners) and their siblings/parents, or high-skilled immigrants.

I think here everybody are agreeing to the same thing. Some valid points,
1) People are agreeing pre-LTTE situation was no rosy.
2) Sinhala-Tamil conflict has some deeper socio-ecomomic reasons
3) Sinhala people were less tolerant. Like usually adaptable minorities, SL Tamils did not learn Sinhalese when "Sinhala-Only" policy came. (while everybody learnt English (and many Chinese) in Singapore.
4) Indian politicians (whatever reasons they might have) in 1980s supported LTTE - camps run by RAW and Indian Army trained LTTE. So, we created a monster. Just like American forces trained OBL in Afghanistan as part of Mujahideen against Russians. So, we reaped what we sowed.
5) Some spineless leaders from TN support LTTE. More than anybody they dont know the difference. Or may be to harvest some votes by flaring up emotions.
6) LTTE is evil and has no place on earth.
7) As soon as conflict is over, we have to make sure that SL will really understand how to solve the crisis. SL has to become secular, adapt common business language (English??) and coexist with the north. Short term, they should perhaps grant limited autonomy. It was done earlier and it worked almost everytime, Just need some leadership. Again, this should be our hope and suggestion. No self-respecting country can be told what to do. We can suggest in exchange for some favors. Or else we will be marginalized.
And for good, we should not meddle into others affairs. Whether we hate or love Congress, we all know Rajiv Gandhi would have made lot of difference than many weak PMs we saw after PVN. We lost him in hands of an evil orgn. So, pray that they are eliminated with ZERO innocent people being killed.

the rumour is that USCIS will accept as much as their parking lot can accommodate 485 applications.
They will at best try not to spill over to the roads nearby causing traffic jams.:eek:
There is possibility that retrogression begins in August. The USCIS maail department will acept only those cases the clerk could manually enter into the system by July 31st and then send all those applications back which he could not enter manually

I heard this group of people - from anti immigrant organizations, plan to intercept fedex trucks going into USCIS next month sort out 485 petitions and steal them and hide them in an undisclosed location.
These people have only one aim in life. Not to allow 485 applications to reach USCIS.
When USCIS does not recieve any 485 applications, they will retrogress. Then this group of people will stop stealing the petitions.
