Hi
My husband does not have an H1 stamp in his passport even though he has been in status since he did not go to india,right now he has got 3 yr extension on the basis of an approved I-140 petition,we are going to india to get our visa stamped next month.
Can anyone advise me whether not having a previous H1 stamp in the passport will create any problems for us in getting stamped now.He was on an L1 visa before converting to H1,he has not gone to india since 2002.

I am currently working with Comapany A with valid I-94 till 09/30/2011(but no visa stamping in passport yet).
Recently My H1B visa tranfer approved with out 1-94 card attached to approval copy(still I am with Company A only)
In this case can I continue with CompanyA.

Hi,
I am on H1 visa and my wife is on H4. Our son was born here last summer with multiple complications, a few of them were life threatening as well. He is recovering well from multiple surgeries but still has issues that require constant medical attention. It is possible that I might be laid off soon and while I am searching hard to find a new job, it is possible that I might have to leave the country to avoid being out of status. With my son's current health condition, my preference is to stay here for some more years till he is completely out of the woods. I wanted to get expert advice from lawyers/members of IV as to what my options are? Will writing to my local senator and asking for a visa that will allow me to stay here even if I lose my job, an option? If so what visa would that be? I have another daughter who is on H4 as well. If we have to convert to b1/b2, is it straightforward and once on b1/b2, can I convert to H1 if I get another job? Are there provisions for parents to get green card based on a sick US citizen child?
Any help in this regard is highly appreciated.

I plan to travel to India during September 2008 and use AP to reenter back into the US. Can someone help answer the below doubts.
1) Since at the port of entry the Immigration Officer will ask whether I am still with the same employer or not- I will have to say I have moved to another company- What happens then?
2)Does using the AP and subsequent answer of "Yes- I have changed my company" trigger a RFE during the GC allocation process since now I have to prove to USCIS that my job is "same or similar" and my pay is >= the pay mentioned in my LC.
3) Has anyone successfully used AP after using AC21 and not had an RFE issued during GC allotment?

I am a green card holder, becoming eligible for citizenship in April 2009. My fianc�e has been in the US for the past 2 plus years on F1. She completes her MS in December this year .We plan to visit our home country in August this year and get married. I thought this was a relatively uncomplicated case till I read in some forum recently that marriage to a permanent resident can be a barrier to being admitted to the U.S. in F-1 status. This is because such a marriage obliterates the "non-immigrant" intent required for F-1 entrants. This could very easily jeopardize her plan to re-enter in F-1 status.
Any thoughts or advice on this? Appreciate all the help.

1.He lost his and his wife's passport alongwith the receipt notices and FP notice.The current visa which has expired and I-94 is also lost.
2.The lost passport includes the old passport with old visa in it.
Can you please throw some light as to what are his options.

Did he filed a police complaint? If not, ask him to file a police complaint and then apply for a duplicate passport with a copy of old passport along with the copy of police complaint.
After getting the duplicate passport, (if he goes to his respective embassy, I think he may be able to get the duplicate in a day) ask him to call USCIS and talk to immigration officer. He also may need to contact his attorney who will provide a plan to obtain duplicate copies.

i have birth certificate which is taken in 2005 but I was born in 1974
some of my friends are saying...as you are born in 1974 and as your
birth certificate was taken in yr 2005, it might cause problems (ins poseses query)
to get the green card.
Is it right?
They are saying me to get Affidivits + non availability certificate now.
will it be a problem if I put my birth certificate....while applying for 485

Your friends are correct. U can avoid RFE in I-485 by using affidavits.

I am an Indian citizen. I have an approved I-140 under National Interest Waiver with a PD of Aug 31, 2007. I am now a permanently employed scientist at a National Lab. I think I am now eligible for application under EB-1 Outstanding researcher category. Is it possible to apply for I-485 without another I-140? It will take quite some time to secure all the recommendation letters to apply for EB-1 (OR). I am wondering if I can bypass the whole process of I-140 and directly apply for adjustment of status based on my approved I-140 saving time and effort.

It depends on job duties mentioned in the LCA. For example, you might be a solution architect and this comes with experience. Some roles could be guiding junior folks, interviewing people, reviewing work done by others, project management, vendor management etc ... Essentially you need to prove your 5-year experience is worth and that is what is needed to fill your current role. Prove that this can not filled by a plain BS graduate with no experience or even a guy/girl with MS degree and no experience. DOL might be thinking why not just a BS degree or BS + 5 years = MS degree.
